RESOLUTION 97-286
APPROVING FrNAL PLAT FOR HOYT PROPERTIES, INC. FOR PLYMOUTH
TECHNOLOGY PARK 2'* ADDMON FOR PROPERTY LOCATED NORTH OF
SC}MDDT LAKE ROAD AND WEST OF 1494 (9MM)
WHEREAS, Hoyt Properties, Inc. has requested approval of a Final Plat for 9.49 acres
located north of Schmidt Lake Road, and west of 1-494.
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
Final Plat for Plymouth Technology Park V Addition for property located north of
Schmidt Lake Read and west of 1-494, subject to the following conditions:
1. This Final Plat approval is for the creation of three lots in the Plymouth Technology
Park, in accordance with the plans received by the City on April 25, 1997, except as
amended by this resoluti.,n.
2. Thera shall be no outside trash disposal facilities and restrictive covenants addressing
this requirement shall be filed with the Final Plat.
3. Setback restrictions along the periphery of the property are as follows:
a) Front yard building setback of 50 feet
b) Side yard building setback of 15 feet
c) Rear yard building setback of 15 feet
d) Front yard parking setback of 25 feet
e) Side and rear yard parking setback of 15 feet
4. Covenants regarding cross access, parking and fire access shall be submitted for staff
review and shall be filed with Hennepin County paior to issuance of building permits.
5. The developer shall be responsible for repairing any damage to the existing trail
during construction. The trail may not be used for storage or access during
construction.
6. Standard Conditions:
a. Complian.:e with the City Engineer's Memorandum.
b. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.

c. Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve awnda of the
date of this Resolution.
d. Any subsequent phrases or expansions are subject to required reviews and
approvals per Ordinamce provisions.
e. Compliance with the Ordinance regarding the location of fire hydratts, post
indicator valve, fire departlment connection, The !ares, and bre lane signage.
f. An 8 IR x 11 inch "As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
g. Park dedication fees shall be cub fes in lieu of land dedication in accordance
with the dedication policy in effect at the time of building permit imam.
h. The Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development The Developer
shall indemnify the City and its officers, employes, and agents for all costs,
damages or expenses which the City may pay or incur in consequence of such
claims, including attorneys' fees.
i. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
j. No building permits shall be issued until a contract has been awarded for
construction of municipal sewer and water.
k. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat
1. CompUance with regulations regarding handicapped parking spaces and
access.
