HomeMy WebLinkAboutCity Council Resolution 1997-284• CITY OF PLYMOUTH RESOLUTION 96 - 284 APPROVING FINAL PLAT FOR C. G. REM INDUSTRIES, INC. FOR PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF HIGHWAY 169 AND SCHMIDT LAKE ROAD (96044F) WHEREAS, C. G. Rein Industries, Inc. has requested approval of a Final Plat on property legall;. described as: Lot 1, Block 1, Epiphany Addition, Hennepin County, Minnesota, and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by C. G. Rein Industries, Inc. for a Final Plat, subject to the following conditions: A Final Plat is approved for the creation of Lots 1, 2 and 3, Block 1, EFiphany Second Addition in accordance with the plans received by the City on April 18, 1997, except as amended by this resolution. 2. Covenants regarding cross access, parking and fire acce ..-3 shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 3. The developer shall construct a six-foot sidewalk along Schmidt Lake Road. 4. A covenant shall be placed on all three lots providing for the jnint use and maintenance of the fixe standing sign on Lot 3. The covenant shall also prohibit the placement of a freestanding sign on Lot 2. 5. The developer shall pay for one leg of a traffic signal that would be installed between Nathan Lane and Highway 169. 6. Am developer shall pay for signage to be located at both entrances of the Church of the Epiphany to discourage cut through traffic as agrees upon by the developer and the church. 7. The developer shall enter into a maintenance agreement with the Church of the Epiphany regarding the shared driveway prior to issuance of building permits. 8. Standard Conditions: A. Compliance with the Cit. Engineer's Memorandum. • 96044, Page 2 B. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new stnrcturea on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and tiro lane signage. F. An 8 1R x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fine Flow calculations prior to the issuance of building Pets. ordinances. and H. I he permit is subject to all applicable codes, regulationsend violation thereof shall be grounds for revocation. j. Park dedication fees !hall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. J. The De%eloper shall hold th. City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in Zonsequence of such claims, including attorneys' fees.
