RESOLUTION 97283
APPROVING A PRELIMINAnY PLAT AND FINAL PLAT FOR TOBIN REAL ESTATE
COMPANY FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF HIGHWAY
55 AND 1494 (97028)
WHEREAS, Tobin Real Estate Company has requested approval of a Preliminary Plat and Final
Plat for the West Suburban Health Campus 2' Addition, located at the northeast corner of
Highway 55 and 1-494; and
WHEREAS, the property is presently legally described as Lot 1, Block 1, West Suburban Health
Campus Addition; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOT.:, that it should and hereby does approve the request of Tobin
Real Estate Company for a Preliminary Plat and Final Plat for West Suburban Health Campus 21
Addition, subject to the following conditions:
1. The approved Preliminary Plat shall be in compliance with the plans received by the City
on April 14, 1997, and the appm% :d Final Plat shall be in compliance with the plans
received by the City on May 20, 1997.
2. Prior to filing the Final Plat, the applicant shall demonstrate compliance with all building
and fire codes due to the proximity of buildings to lot lines for the Phase 1 and Phase II
buildings.
3. A maintenance agreement Is required between the Developer and the City for the water
quality ponds.
4. Cross -casements for access, driveways, parking, and utilities shall be filed with the Final
Plat.
5. Standard Conditions:
A. Comrliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's expense.
C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites adjacent to. or containing any open storm water drainage
facility.
D. Private driveway access shall be limited to internal public roads and restricted
th►rr. Highway 53 and 1-49.1.

E. Location and number of fire hydrants shall be approved by the Fire
Division.
F. Submittal and approval of fire flow data prior to filing the Final Plat.
G. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits for the Phase 11 building.
H. The Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third parties for damages sustained or
costs incurred rmulting from plat approval and development. The Developer shall
indemnify the City and its officers, employees, and agents for all costs, damages,
or expenses which the City may pay or incur in consequence of such claims,
including attomeye fees.
