ABSOLUTION 97-280
APPROVING A SITE PLAN AMENDMENT FOR JAMES MCCLEARY FOR
PROPERTY LOCATED AT 10200 31sT AVENUE NORTH (95015)
WHEREAS. James McCleary has requested approval of a Site Flan Amendment for
property legally deses ibed as follows:
Lot 2, Block 1, Ryan Business Center, Hennepin County.
WHEREAS, ft Planning Commission has reviewed said request at a duly called
Public Mating and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by James McCleary for a Site Plan Amendment for a noise wall. subject to
the following conditions:
1. This +approval permits the construction of a 325 foot long noise wall, in accordance
with the plans received by the City on April 14, 1997. except as amended by this
resolution.
2. Construction of the wall is subject to the execution of an agreement between
Ameridata, James McCleary, the City of Plymouth and the affected humeowoers
3. Prior to the issuance of building permits, the plans shall be modified to show the
northernmost 24 fat of the wall at an elevation of 940.0 fat and the southernmost
eight feet at an elevation of 936.0 fat and the immediately adjoining 24 feet an
elevation of 940.0 feet.
4. If costs allow, the wall could be extended on the south end to provide an additional
step down to an elevation of 932.0 fat.
5. Trees affected by the construction shall be relocated. Existing landscaping on the
Ameridata site that is affected by the construction of the wall shall be relocated.
Adopted by the City Council on May 7, 1997.
