RESOLUTION NO. 97 - 274
AUTHORIZING THE VACATION OF FART OF A
DRAINAGE AND UTILITY EASEMENT, AND DRAINAGE
EASEMENT FOR PONDING PURPOSES
LOT 29 BLOCK 1, PLYMOUTH OAKS ADDITION
WHEREAS, a petition was received to vacate part of a drainage and utility easement, and
drainage easement for ponding purposes in Lot 2, Block 1, Plymouth Oaks Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated. and
WHEREAS, a public hearing with respect to said vacation was scheduled for May 7, 1997 in
accordance with Minnesota Statutes *12.951 and the City Charter Section 12.06; and
WHrREAS, a notice of publication of said hearing was published and posted two weeks prior
to the mating of May 7,1997; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on May 7, 1997 to info-vn any and all
interested parties relevant to the vacation of part of a drainage and utility easement, and
drainage easement for ponding purposes in Lot 2, Block t, Plymouth Oaks Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easement
and drainage easement for ponding purposes be vacated:
Commencing at the most easterly comer of said Lot 2; thence northwesterly
along the northeast line of said Lot 2, a distance of 108.65 feet; thence South
45 degrees 14 minutes 19 seconds West, 6.65 feet; to the point of beginning of
the parcel to be described; thence South 45 degrees 14 minutes 19 seconds
West, 29.81 feet; thence North 47 degrees 44 minutes 32 seconds West, 29.30
feet; thence North 42 degrees 15 minutes 28 seconds East, 20.72 feet; thence
North 80 degrees 55 minutes 03 seconds East, 23.02 feet; thence South 19
degrees 17 minutes 00 seconds East, 18.74 feet to the point of beginning and
there termitlating.
