FOR PLUM TREE 3M ADDITION LOCATED AT THE NORTHWEST QUADRANT OF PEONY LANE AND 'OLD ROCKFORD ROAD (97034F) WHEREAS, Lundgren Bros. Construction Inc. has requested approval of a Residential Planned Unit Development Final Plat for the development of approximately 3510 acres located at the .wrthwest quadrant of Peony Lane and Old Rockford Road; and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat and Development Contract for Plum Tree 3M Addition for property located at the northwest quadrant of Peony Lane and Old Rockford Road; and, FURTHER. that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER. that the following conditions be met prior to recording of, and related to said plat: 1. This Final Plat approval is for the creation of thirty-six lots. four Homeowner Association owned outlots, and two outlots in the Plum Tree Std Addition, in accordance with the plans received by the City on March 26, 1997, except as amended by this resolution. 2. Compliance with the City Engineer's Memorandum. 3. Removal of all hazardous trees from the property at the owner's expense. 4. No building permit shall be issued until a contract has been awarded for sewer and water. 5. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. 6. Street names shall comply with the City Street Naming System. 7. Change Queensland Avenue North to Queensland Lane North on Final Plat. • • 97034F, Paige 2 8. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 9. No building permits shall be issued until the Final Plat is filed and recorded with Hein County. 10. Private driveway so= shall be limited to internal public roads and restricted from County Road 9 (Old Rockford Road) end Peony Lane, 11. Screening along County Road 9 (Old Rockford Road) and Peony Lane shall be provided in accordance with the approved Landscape Plan. 12. Final Plat mylars shall refer to RPUD 95-1. 13. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the Final Plat. Specific reference shall be made to the maintenance of the active recreational features and the landscaping in street islands. 14. Development Standards: a. 25 -foot front yard setback b. 6 -foot side yard setback to garages c. 9 -foot side yard setback to living space d. 20 -foot rear yard setback e. 50 -foot setback to Peony Lane Right of Way f. 25 -foot wetland rear yard setback g. 10400t wetland side yard setback h. 10 -foot average buffer 15. Minimum lot size shall be 9,000 square feet. 16. Maximum lot coverage shall be 25 percent. 17. Approved minimum lot width shall be 75 feet. 18. Location and number of fire hydrants shall be approved by the Fire Division. 19. Perimeter monuments and kiosks shall be in conformance with the approved R.PUD Preliminary Plan. 20. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. The agreement shall include "common" landscaping and buffer monumentation. • • 970309 Page 3 21. The developer shall install wethtnd monumentation delinadng the buffo boundary within each lot. Tim monument design shall be approved by the Community Development Department.
