HomeMy WebLinkAboutCity Council Resolution 1997-256L] CITY OF PLYMOUTH RESOLUTION 97 - 256 APPROVING FINAL PLAT AND ASSESSMENT AGREEMENT FOR FOURTH BAPTIST CHURCH FOR FOURTH BAPTIST CHURCH ADDITION AT THE SOUTHEAST QUADRANT OF FORESTVIEW LANE AND HIGHWAY 55 (96185F) WHEREAS, Fourth Baptist Church has requested a Final Plat approval for Fourth Baptist Church Addition, a plat of one 23.89 acre lot; and WHEREAS, the subject property is legally described as follows: Lots 1 through 6. Block 1, Schiebe's Business Park, Hennepin County. 0 The part of the Southwest Quarter of the Northeast Quarter and of the Southeast Quarter of the Northwest Quarter of Section 35, Township 118, Mange 22, Hennepin County, Minnesota, described as follows: Commencing at the Southeast corner of said Southwest Quarter of the Northeast Quarter; thence on an assumed bearing of North 89 degrees 20 minutes 05 seconds West along the south line of said Southwest Quarter of the Northeast Quarter and the Southeast Quarter of the Northwest Quarter 1313.34 feet; thence continue North 89 degrees 20 minutes 05 seconds West 646.30 feet; thence North 0 degrees 05 minutes 53 seconds East 998.00 feet; thence South 89 degrees 20 minutes 05 seconds East 1120.23 feet; thence South 0 degrees 10 minutes 06 seconds West 402.96 feet to the point of beginning; thence continue South 0 degrees 10 minutes 06 seconds West 535.04 kat; thence North 89 degrees 20 minutes 05 seconds West 472.71 feet; thence South 0 degrees 10 minutes 06 seconds West 60.00 feet to the south line of said Southeast Quarter of the Northwest Quarter; thence easterly along the south line of said Southeast Quarter of the Northwest Quarter and the Southwest Quarter of the Northeast Quarter to the southeast confer of said Southwest Quarter of the Northeast Quarter; thence north along the east line of said Southwest Quarter of the Northeast Quarter 595.02 feet; thence westerly to the point of beginning. WHEREAS, the City staff has prepared an Assessment Agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Fourtn Baptist Church for Final Plat and Assessment Agreement for Fourth Baptist Church Addition located south of Ilighway 55 anti east of Forestview Lane, subject to the following conditions: • Resolution 57- 256 Page 2 1. Final Plat approval is hereby granted for Fourth Baptist Church Addition in acr-irdanee with trio plans received by the City on March 20, 1997, and April 28, 19Y7, except as amended by this resolution. 2. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance with Zonir+; Ordinance Section 21670.07. 3. Signage for this site shall be in compliance with the plans received by the City on January 21, 1997. The site shall be allowed one freestanding sign near the Forestview Lane entrance, not to exceed 64 square feet in sign area and one directional sign at the eastern entrance not to exceed 4 square feet. 4. Allowable building area calculations (the allowable size of the building with respect to the proposed building material type and interior use of the building) will be finalized with the Building Delartment prior to issuance of building permits. S. The developer must obtain all necessary permits from the Bassett Creek Watershed District. 6. No radio transmitters will be allowed on site. 7. The developer will designate van and bus parking on the north side. A the building to be screened from adjacent residential. 8. No outdoor lighting will be allowed on the playing fields. 9. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79.90 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of lie required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. F. An 8 1/2 x I 1 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. to Resolution 97- 256 Page 3 n H. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. I. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting liom plat approval and development. Tha Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or ipcur in consequence of such claims, including attorneys' fees. J. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. K. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. L. No building permits shall be issued until an assessment agreement has been approved by the City. M. Submittal of requited utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. N. Compliance with regulations regarding handicapped parking spaces and access.
