APPROVING FENAL PLAT AND DEVELOPMENT CONTRACT FOR CRAIG SCHERBF.R

WHEREAS, Craig Scherber dt Associates do Lomb dt Associates. Inc. has requested
approval of a Final Plat for Holly Creek .0 Addition, a development of 34 single family
detached lots on a 20.06 -acre site located north of 39th Avenue and %vst of Dunkirk Lane; and
WHEREAS, the City staff has prepared a Development Contrast covering the improvements
related to said plat.
NOW. THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA. that it should and hereby does approve the Final Plat
and Development Contract for Holly Creek Sr Addition for property located north of 39th
Avenue and west of Dunkirk Lane; std.
FURTHER, that lire Development Contract for said plat be approved, and that the Mayor and
City Manager be authorized to execute the Development Contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. This Final Plat approval is for the creation of 34 leas as the Holly Creek 31 Addition, in
accordance with the plans receiNed by the City on March 20. 1997, except as amended by
this resolution.
2. Prior to filing the Final Plat, payment of park dobdication fees -in -lieu of dedication in
accordance with the Dedication Policy in effect at the time of recording the Final Plat.
3. Appropriate legal documents regarding Homeowners Association documents, covenants
and restrictions, as approved by the Lity Attorney, shall be riled with tha Final Plat.
4. Minimum building setbacl a and maximum lot coverage shall be as specified by the RSF-2
zoning district.
S. The City has approved a Wetland Mitigation Plan. All elements of that plan must be
constructed by the developer and approved by the City before the Final Plat is recorded
with Hennepin County.

6. Compliance with the conditions of the Wetland Mitigation Plan, as approved by Resolution
97.291.
7. Compliance with the approved Concept Plan Mpdremem reWiug to alternative bullets,
including the required Planting along 40' Avenue.
8. Prior to issuance of building permits. wetland buffer monumemts shall be installed in
accordance with Section 21670.07 of the Zoning Ordinanoe. The monument design shall
be approved by the Community Development Department.
9. Compliance with the Tree Preservation Ordinance.
10. Tie developer shall record the access easement documents for the shared driveway for
Lots 3 and 4 of Block 2 with the Final Plat.
11. Street light standards shall not be placed in the area between Lots 11 and 12 of Block 2. or
in the area between Lots 4 and 5 of Block 3.
12. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
C. No building permits shall be issued until a contract has been awarded for sewer
and water.
d. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
L Street names shall comply with the City Street Naming System.
g. Private driveway access shall be limited to internal public roads and restricted
from Dunkirk Lane.
h. Submission of the required Financial Guarantee and Site Improvement
Performance Agreement prior to issuance of building permits, for completion of
site improvements within twelve months of the date of the resolution. The Site
Improvement Agreement sh ill include. but not be limited to, the required
plantings as indicated in the Planting Plan received by the Cky on June 7, 1996,
and the wetland buffer monmm:nts.
I. Subsequent phases shall be subject to orditume provisions Sir plan and plat
applications for the review and approval.
j. Location and number of fire hydrants shall be approved by the Fire
Division.

k. Submittal and approval of fire now data prior to issuance of building permits.
1. All lot; abutting ponds shall have basearmt elevations at least two feet above
the 100 year Lith water elevation.
M. A maintenance afteement is required between the Developer and the City for
the water quality ponds.
n. The Developer shall hold the City and its officers, employees. and aunts
harmless from cl-tims made by itself and third parties for damages susuired or
coats incurred aewhintp from plat approval and development. The Developer
shall indcamify the City and its officers. employees, and agents for 43 coons,
damagea. or expenses which the City may pay or hm in consequence of such
claims, inchndh g attorneys fees.
