BE IT RESOLVED by the City Council of the City of Plymouth that an amusement license is hereby issued to Gopher State Expositions. Inc., for a carnival at Four Seasons Mall located at the southwest corner of Highway 169 and Rockford Road, on May 29 through June 1. 1997, during the hours of 10 a.m. to 11 p.m. Adopted by the City Council on May 7, 1997. • CITY OF PLYMOUTH RESOLUTION 97 - 2S0 APPROVING A CONDITIONAL USE PERMIT AND VARIANCE FOR PATRICK BUSCH FOR PROPERTY LOCATED NORTH OF MEDINA ROAD AND EAST OF BROCKTON LANE (97021) WHEREAS. Patrick Busch has requested approval of a Conditional Use Permit and Variance to allow the construction of a single family home on a lot without street frontage on property legally described as: The Southeast Qjerter of the Northwest Quarter of Section 18, Township 118 North, Range 22 West of the V Principal :Meridian. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, 'THEREFORE, BE IT HEREBY RFSOLVED BY fHE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Patrick Busch for a Conditional Use Permit and Variance, subject to the following conditions: 1. A variance is approved from Section 500.43. Subd. 4 of the Subdivision Code to allow a single family home to be constructed on a lot without street frontage, based on the following findings: a) The property is an existing lot of record which does not front on a public street. b) Granting the variance will not be detrimental to the public welfare or injurious to adjoining properties. c) The unique size of the lot, large wetlands, and lack of public utilities and services creates a special circumstance that warrants the granting of a variance. d) The variance is necessary for the preservation and enjoyment of a substantial property right of the applicant. 2. A Conditional Use Permit is approved to allow a single family home to be constructed on a lot that does not abut an improved and City accepted street, subject to the application dated February 18, 1997 and the revised plan dated April 15, 1997. 3. This approval shall expir: one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or • 97021 - CUP and Variance Page 2 applicant has received prior approva, from the City to extend the expiration date for up to one additional year, as regulated undo Section 21045.09 of the Zoning Ordinance. 4. There shall be no encrovAwv nt into any wetland as defined by the Wetland Conservation Act unless a wetland application is r.oproved by the City. 6. Cumpliance with Policy Resolution 19-80 regarding minimum floor elevations for new structures on sites adjacent to, or ccnWning +tny open storm water drainage facility. 7.
