HomeMy WebLinkAboutCity Council Resolution 1997-243CITY OF PLYMOU'T'H RESOLUTION 97- 213 APPROVING CONDITIONAL USE PERMIT AND VARIANCES FOR JANCO, INC. FOR PROPERTY LOCATED NORTH OF THE SOO LINE RAILWAY AND EAST OF PEONY LANE (96150) WHEREAS, Junco, Inc, has requested approval for a Conditional Use Permit and Variances for Conor Meadows Plat Two located north of the Soo Line Railway and East of Peony Lane (directly east of the Conor Meadw.vs plat); and, WHEREAS, the property is legally described as that part of the Northwest Quarter of the Southwest Quarter of Section 8, Township 118 North, Range 22, West of the A Principal Meridian, lying Northwesterly of the Northwesterly line of the railroad right-of-way, according to the U.S. Government survey thereof, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said requests at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Janco, Inc. for a Conditional Ilse Permit and Variances for property located north of the Soo Line Railway and East of Peony Lane (directly east of the Conor Meadows plat), based on the finding that the Conditional Use Permit standards and Variance standards have been met, and subject to the following conditions: 1. Approval of the Conditional Use Permit and Variances is contingent on the adoption of the associated Lend Use Guide Plan Amendment and Rezoning. 2. This resolution approves a Conditional Ilse Permit to allow 19 single family detached homes in the Conor Meadows Plat Two subdivision, which would be rezoned to RMF -2 under the proposal, in accordance with rhe plans received by the City on March 14, 1997, with revic ions dated April 2, 1997, except as amended by this resolution. 3. This resolution approves a Zoning Ordinance Variance to allow s reduction in the front yard setback requirement from 25 feet to 20 feet for Lots 12 through 14, Block 2 in accordance with the plans rest ived by the City on March 14, 1997, with revisions dated April 2, 1997, except a s amended by this resolution. 4. This resolution approves a Subdivision Co le Variance to allow Lot 15, Block 2 and Lot 3, Block 3 (as indicated on the Preliminary Plat) to be created within • Resolution 97- 243 Page 2 frontage on a public street in accordance with the plan received by the City on March 149 19917, with revisions dated April 2, 1997, except as amended by this resolution.
