MINNESOTA, that it should and hereby does app rove f Inc. for a Preliminary Plat and Site Plan for Conor Meadows Plat Two, subject to the following conditions: 1. Approval of the Preliminary Plat is contingent on the adoption of the associated Land Use Guide Plan Amendment and Rezoning. 2. The approved Preliminary Plat and Site plan shall be in complianheeds by� March 14, 1497, with revisions dated April 21 1997, except Resolution. 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat in combination with a trail easement along Schmidt ie Road. Notice of the trall easement ts so that potential buyers will be aware of the tLbe cture trail foluded in r development/sales documents this location. 4. Approval of a Wedand Mitigation Plan prior to the issuance of grading permit and filing of the Fund Plat. The Final Plat shall be revised to be consistent with the Mitigation Plan. 5. Prior to the issuance of building permits, wedand buffer monuments shall be installed in accordance with Section 6, Subdivision C.7 of the Zoning Ordinance. A maintenance agreement is required between the Developer and the City for the water quality ponds. N. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. 0. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, ami agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
