HomeMy WebLinkAboutCity Council Resolution 1997-237• CITY OF PLYMOUTH RESOLUTION No, 97.237 AUTHORIZING THE VACATION OF DRAINAGE AND UTQ.TTY EASEMENT AND DRAINAGE EASEMENT FOR PONDING PURPOSES LOT 49 BLOCK 2 SEVEN PONDS FOURTH ADDITION WHEREAS, a petition was received to vacate drainage and utility easement and drainage easement for ponding purposes in Lot 4, Block 2. Seven Ponds Fourth Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHI nEAS. a public hearing with respect to said vacation was sc:sduled for April 16, 1997 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the mating of April 16,1997; and WHEREAS, all property owners aQacent to the proposed vacation were duly notified by mail; and WHEREAS, am Council did hold a public heating on April 16. 1997 to Inform any and all interested parties relevant to the vacation of drainage and utility easement and drainage easement for ponding purposes in Lot 4, Block 2, Seven Ponds Fourth Addition; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following easements be vacated: Description of portion of drainage and utility easement and drainage easement for ponding purposes now located on Lot 4. Block 2. Seven Ponds Fourth Addition to be vacated: That part of Lot 4, Block 2, Seven Ponds Fourth Addition, described as follows: Commencing at the southeast comer of Lot 4; th:nue in a northwesterly direction a distance of 82 feet to an iron monument located on the northeast boundary line of said Lot 4. which is the point of beginning of the parcel to be described; thence continuing 19 feet in a northwesterly direction along the northeast boundary line of Lot 4 to a point; thence in s southwesterly direction to an iron monument on the southwesterly boundary line of Lot 4 which is 117.0 feet northwest of the southwest corner of said Lot 4; thence northeasterly to the point of beginning; excepting therefrom an area ten (10) feet in width �1[Yyyl,lydl\p/p�YA[AItOMAGSp�,U�PMptlEq�e61.A,t Resolution No. 97 - PAP Two • immediately adjacent to and southwesterly of the northeasterly baudary line of Lot 4 and an area six (6) feet in width immediately aoaceat to and nortbeasterly of the southwest boundary lin of said Lot 4, according to the plat on file or of record in the ofrm of the Registrar of Ticks.
