HomeMy WebLinkAboutCity Council Resolution 1997-229• CITY OF PLYMOUTH RESOLUTION N0.97 -229 AUTHORIZING CONDEMNATION PROCEEDINGS SCHIVDDT LAKE ROAD CITY PROJECT NO, 70M WHEREAS, the City of Plymouth has undertaken City Project No. 7005; and WHEREAS, in order to construct the improvements, certain permanent and temporary easements are required; and WHEREAS, the City Council finds It necessary, proper, and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; and WHEREAS, the City Council finds that the construction schedule for said public project makes it necessary to acquire title to and possession of the easement interests prior to the filing of the final report of the condemnation commissioners to be appointed by the district court; and WHEREAS, the use of MJ0. SM. Sec. 117.042 (1988), so-called "Quick -Take" statute, win enable the City to timely acquire the required lands; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence condemnation proceedings utilizing said "Quick -Take" statute for City Project No. 7005 for the fonowmg described easements within the following described parcels: The East Half of the Northeast Quarter of Section 7, Township 118, Range 22, Hennepin County, Minnesota. A perpetual easement for drainage and utility purposes over, under, across, and thn %ugh the South 10 feet of the East 250 feet of said East Half of Northeast Quarter. and Q-%MG%►taWMMWRE.ut r.nvnu WC Resolution No. 97- 229 )Page 2 I LJ Together with a 40 foot perpMW easement for drainage and utility purposes over, under, across and through said East Half of Northeast Quam. The centerline of said 40 foot perpetual easement is described as follows: Commencing at the southeast corner of said East Half of Northeast Quarter; thence westerly along the south lire of said Eag Half of Nordteaat Quarter a distance of 603 fat to the begiooing of centerline to be described; thence northwesterly, deflecting to the right 74 deptm 00 minutes 00 seconds a distance of 90 fat and said centerline there terminating. The sidelines of said perpetual easement are to be prolonged or shortened to terminate at the north and south ends of said described centerfine. and A temporary easement for construction purposes over, under, across, and through the South 30 fat of said Fast Half of Northeast Quarter. Together with a temporary easement for construction purposes over, under, across, and through the North 30 fat of the South 60 feet of the East 200 fat of said East Half of Northeast Quarter. and Together with a temporary easement for construction purposes over, under, across, and duvugh the North 30 feet of the South 80 fat of the West 200 feet of the East 710 fat of said East Half of Northeast Quarter. Township 118, Range 22, Hennepin County, Minnesota. a:WI MMMM7047IMMUUMONDAW Resolution No. 97-229 Page 3 A perpetual easement for drainage and utility purposes over, under, across, and through that part described as follows: Beginning at the southeast corner of said West 672 feet; thence north along the east line of said West 672 feet a distance of 100 feet; thence west parallel with the south line of said Northwest Quarter a distance of 300 feet; thence northwesterly to a point on the north line of said South 336.65 feet distant 190 feet east from the northwest corner thereof; thence west along said north line to said northwest corner; thence south along the west line of said Northwest Quarter to the southwest :orner thereof; thence east along the south line of said Northwest Quarter to the point of beginning.
