FOR NORTHWEST BUSINESS CAMPUS 13'" ADDTPON FOR PROPERTY LOCATED EAST OF NORTHWEST BLVD. BETWEEN HIGHWAY 55 AND CAMPUS DRIVE (96155) WHEREAS, BRVI', Inc. has requested approval of a Final Plat for property more specifically described as follows: Lot 1, Block 2, Northwest Business Campus 4+ Addition, Hennepin County, Minnesota. WHEREAS, this property is part of MPUD 81-1 and any action by the City Council at this time does not affect the remainder of the approvals for MPUD 81-1; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of BRW, Inc. for a Final Plat for property located east of Northwest Blvd. Between Highway 55 and Campus Drive, subject to the following conditions: I. Final Plat approval is hereby granted for Northwest Business Campus i r Addition in accordance with the plans received by the City on March 7,1997, except as amended by this resolution. 2. Covenants regarding cross access, parking, and fire access shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 3. The Final Plat shall identify the edge of Mn/DOT right-of-way and show the distances from the center lines of Highway 55 and Northwest Blvd. 4. There shall be no outside trash disposal facilities and restrictive covenants addressing this requirement shall be filed with the Final Plat. S. Standard Conditions: L Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open atoms water drainage facility. c. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions, e. Compliance with ilia Ordinance regarding the location of fire hydrants, post Indicator valve, fire department connection, fire lanes, aid fisc lane signage. 0 96182 Page 2 E An 8 1R x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. h. Access shall be restricted from Highway SS and Northwest Blvd. i. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnfl r the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attomeys' fees. j. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. k. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. 1. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat m. Compliance with regulations regarding handicapped parking spaces and access.
