HomeMy WebLinkAboutCity Council Resolution 1997-215• CITY OF PLYMOUTH RESOLUTION 97 - APPROVING PUD GENERAL PLAN AMENDMENT' .* STI' tNTF.RIM USE PERMIT FOR TOBIN REAL ESTATE COMPANY FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF HIGHWAY SS AND I494 (97013) WHEREAS, Tobin Real Estate Company has requested approval of a PUD General Plan Amendmert and Interim Use Permit to allow a reduction in the required number of parking spaces for property legally described as follows: Lot 1, Block 1, West Suburban Health Campus Addition, Hennepin County, Minnesota. WHEREAS, this property is located within a Planned Unit Development (Iu1PUD 81.1) and any action by the City Council does not affect the remainder of the approvals for MPUD 81-1; arid, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Tobin Real Estate Company for a PUD General Plan Amendment and Interim Use Permit for the WestHealth Phase B building, a four-story 79,376 square foot medical office building, subject to the following conditions: 1. The PUD General Plan Amendment is for a four-story, 79,376 square foot medical office building, according to the plans received by the City on March 18, 1997, except as amended by this resolution. 2. The Interim Use Permit approves a reduction in the required number of parking spacers from 858 to 683 based on documentation provided s4owing that the 683 spaces would be adequate to serve the projected needs of this facility. 3. The applicant shall reserve space on the site for future con3buction of 120 additional parking spaces to be installed if the facility experiences a parking shortage and the City deems the additional parking necessary. 4. This resolution approves the use of grass seed in certain areas as indicated on the plans. S. I?evelopmant standards are as requireu for the B -C (Business Campus) District. 6. Covenants regarding cross access, parking and fire access shall be submitttJ for staff review and shall be filed with Hennepin County prior to issuance of building permits. • Resolution 97- 215 (File 97013) Page 2 of 3 7. A luminaire plan shall be submitted as part of the PUD Final Plan submission. 8. Approval of the NPDES Permit and Bassett Creek Permit prior to issuance of building pia 9. Prior to issuance of building permits, a maintenance agreement is required between the City and the developer for the Water Quality pond. 10. The revised drainage calculations are presently under review. Results of this review could result in the need to revise the grading and drainage plan. Any required revisions would need to be addressed prior to Final Plan approval. 1 I. Standard Conditions: A. Compliance with the City Engineers Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliauee with the Ordinance regarding the location of fire hydrants, post indicator valve, fir • department connection, fire lanes, and fire lane signage. F. An 81/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds. G. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of buildinh permit issuance, or in accordance with a phased payment s:hedule as rcuay be approved by the Parks Department. H. Access shall be restricted from Highway SS and 1-494. 1. The Developer shall hold the City and its officers, employees, and agents harmless firom claims made by itself and third parties for damages sustained or costs incurred resulting from plan approval and development. The Developer shall indemnify the City and its officers, employees, and agents for -all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
