RESOLUTION 97 - 214
APPROVING PRELIMINARY PLAT AND PUD GENERAL PLAN FOR HOYT
PROPERTIES, INC. FOR PROPERTY LOCATED NORTH OF SCHMIDT LAKE ROAD
AND WEST OF 1-494 (97003)
WHEREAS, Hoyt Propuft Inc. has requested approval of a Preliminary Plat and PUD General
Plan fbr property legally described as follovis;
Lot 2 and Lot 3, Block 1, Plymou t Technology Park according to the plat thereof on file
and of record in the office of the Registrar of Titles, Hennepin County, Minnesota.
All that part of Lot 11, Block 1, Plymouth Technology Park, according to the plat thereof
on file ad of record in the office of the RegWv of Titles. Hennepin County, Mirumote,
which ties easterly of Line A. described as follows: Commencing at the southeast coma
of said Lot 1; thence on an assumed hearing of South 89 deem 58 minutes 47 seconds
West along the southerly line of said Lot 1 for 471.11 feet to the actual point of beginning
of said Line A; thence north 00 degrees 01 minutes 13 seconds West for 958.07 feet to
the northerly line of said Lot 1 and there terminating; Excepting therefrom all that part of
said Lot 1 lying westerly of a lice parallel with and distant 245.00 feet easterly of Lire A
and lying northerly of a fine prrdlel with and distant 638.07 feet nortimty from said
southerly lice of Lot 1.
WHEREAS, the Planning Commission bas reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the n Nuest by Hoyt
Properties, Inc. for a Preliminary Plat and PUD General Plan, subject to the following conditions:
1. Approval of the Preliminary allat and PUD General Plan are subject to the approval of the
Lead Use Guide Plan Amendment and Rezoning.
2. A Site Plan is approved :or two 25,721 square foot officerV arehouse buildings, a 26,465
square foot officetWmehouse building, 48,596 square feet ofiiwAvarehouse building, and a
87,440 square foot officv*mhouse building, according to the pleas received by the City on
February 28,1997.
3. A Preliminary Plat is anproved for the creation of Lots 1-3, Block 1, Plymouth Technology
Park Second Addition.

and architectural deviling will be enforced on each building. These requinemeats will be
verified prior to issuance of building permits.
7. Covenants regarding ceras access, puking and lire sexes shall be submitted for staff review
and doff be filed with Hennepin County prior to issuance of building permits.

10. Standard Conditions:

b. Compliance with Policy Resolution 7940 regarding minimum floor elevations for
new structures on sites a4la cent to, or containing any open storm water drainage
facility.
c. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within t%%vlve months of the date of this Resolution.
d. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
e. Compliance with the Ordinance regaMing the location of fire hydrants, post indicator
valve, fire department connection, fun lamm...and fire lane signage.

relew or reduction o! any site improvement bonds per City Policy.
S. Park dedication fees @.hall be cash fees in lieu of bend dedication in accordance with
the dedication policy in effect at the time of building permit issuance.
h. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the
City and its officers, employees, and agents for all costs, damages or expenses which
the City may pay or incur in consequence of such claims, includmg attorneys' fees.
i. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepir. County.
j. No building permits shall be issued until a oontract'ras been awarded for construction
of municipal sewer and water.

1. Compliance with regulations regarding handicapped parking spaces and access.
