CITY OF PLYMOUTH
RESOLUTION NO. 97 - 203
AUTHORIZING THE VACATION OF A PERPETUAL
EASEMENT FOR UTILITY PURPOSES
PIN 07-118-22.4140002
WEEREAS, a petition was received to vacate a perpetual easement for utility purposes in PIN
07-118-22-41-0002; and
WHEREAS, aid petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for April 2, 1997 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two 4 deb prior
to the meeting of April 2, 1997; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
NEMREAS, the Council did bold a public heating on April 2, 1997 to inforn any and all
interested parties relevant to the vacation of a pe.retual easement for udlity purposes in PIN
07-118-22-41-0002; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, T liEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following perpetual easement for utility
purposes be vacated:
A perpetual amaent for utility purposes over, under, across and through that
part of the above described property wnich Iles within the following described
area: Commencing at the northwest corner of the northeast quarter of the
southeast quarter of Section 7, Township 118 North, Range 22 West; thence
south 00 degrees 16 minutes 24 seconds west, assumed baring, along the west
line of said northeast quarter of the southeast quarter a distance of 387.53 feat to
the point of beginning; thence continuing south 00 degwo 16 minutes 24
seconds west 20.00 feet; thence north 90 degrees 00 minutes W seconds an
110.05 feet: thence north 00 degrees 00 minutes 00 seconds cast 20.00 feet;
thence south 90 degrees 00 minutes 00 seconds west 109.95 feet to the point of
beginning. Except that part which lies within the above described permanent
street and utility easement as rycorded in Document No. 6545236.
Adopted by the City Council on April 2, 1997.
