CITY OF PLYMOUTH
RESOLUTION NO. 97 - 198
ORDERING PUBLIC HEARING ON THE V ACATION OF
THE POND EASEMENT GRANTED TO THE CITY PURSUANT TO
PARAGRAPH EIGHT OF THAT CERTAIN DECLARATION OF EASEMENT
AND REAL COVENANTS DATED FEBRUARY 159 1995 CONTAINED WrrM
OUTLOT A, CARLSON CENTER 12" ADDITION
WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Lary Chiat on
behalf of Carlson Real Estate Company has petitioned the City Council for the vacation of a pond
easement which was Wanted to the City pursuant to Paragraph Eight of that certain Declaration of
Easeeme= and Real Covenants dated February 15, 1995.:
The pond easement over, under, and across Oudot A. Carlson Cerner 12" Addition
to be vacated is descnW as follows:
Commencing at the most northerly corner of said Outlot A; thence south 61
degrees 23 minutes 46 seconds east assumed bearing along the northeasterly line of
said Outlot A; thence south 72 degrees 24 minutes 43 seconds east a distance of
78.73 feet; thence south 8 degrees 50 minutes 25 seconds east a distance of 237.67
fat to the point of beginning; thence south 81 degrees 09 minutes 39 seconds west
a distance of 85 fat; thence south 17 degrees 47 minutes 42 seconds west a
distance of 157.52 feet; thence south 87 degrees 40 minutes 10 seconds east a
distance of 35.00 fat; thence south 02 degrees 19 minutes 50 seconds west, a
distance of 48.81 feet; thence south 87 degrees 40 minutes 10 seconds east a
distance of 20 fat; thence north 2 degrees 19 minutes 50 seconds east a distance of
33 feet; dunce north 81 degrees 09 minutes 39 seconds east a distance of 104.33
fat to the easterly line of said Oudot A; thence north 08 degrees 50 minutes 25
seconds west a distance of 165 feet to the point of beginning.
AND WHEREAS, the City Couurcil has reviewed said request and found the same to be in order;
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of May 71
1997 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as
the time and plat* for the public nearing of said petition and directs the administrative stiff to
publish notice of said hearing as provided by law.
