WHEREAS, Ryan Companies has requested approval of a 13.2 -foot Variance to the required front yard setback of 20 -feet, iu order tc construct a monument sign fo. Value Rx; and WHEREAS, the subject property is legally described as: That part of Lot 1, Block 1, Drakeland Business and Technical Center, according to the recorded plat, thereof, Hennepin County, Minnesota, lying Northerly, Northeasterly and Northwesterly of the following described line and its Westerly extension: Commencing at the most Easterly Southeast comer of said Lot l; thence on an assumed bearing of North 00 degrees 39 minutes 09 seconds East, along the East line of said Lot 1, a distance of 129.00 fat to the point of beginning of said line; thence North 68 degrees 34 minutes 54 seconds West 403.40 fat; thence North 45 degrees 43 minutes 18 seconds West 786.63 feet; thence South 69 degrees 17 minutes 27 seconds West 63.62 fat to the intersection with the West line of said Lot 2 and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public mating and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryan Companies for a Variance based on the fording that the Variance Standards have been met, subject to the following findings and conditions: 1. This Variance allows construction of a fieestanding business sign with a front yard setback of 4.8 -fat, versus the Sign Ordinance requirement of 20-fect, in accordance with the application received by the City on February 11. W. 2. The Encroachment Agreement must be recorded at Hennepin County prior to issuance of a sign permit. 3. A particular hardship to the owner has been demonstrated due to the number of trees located near the entrance to the property, and the curve of Nathan Lane. 4. The placement of the proposal sign will not interfere with traffic visibility or impede safety by obstructing vision of pedestrians or motor vehicle operators. 5.
