AUTHORIMNG THE VACATION OF
PART OF DUNm3RK LANE RIGHT-OF-WAY
SEVEN PONDS SECOND ADDITION, lEIErI MPIN COUNTY91bID►iWWWA
DUNKMK MEADOWS, COUNTY, MKNESOTA
WAS, a petition was received to vacate pan of Dunkirk Lane Right -of --Way, Seven
Ponds Second Addition, Hennepin Coin►, Minnesota, Dunldrh Meadows, Hennepin County,
Minnesota; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the ams
proposed to be vacated; and
WHEREAS, a public hearing with m p5ct to said madim was scheduled for March S, 1997 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and.
WHEREAS, a notice of 1 ubliation of said hearing was published and posted two woeks prior
to the meeting of March: s 1947; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did bold a public hearing on March S, 1997 to inform any and all
interested parts relevant to the vacation of pari of Dunkirk Lane Right -0f --Way, Seven Ponds
Second Addition, Heanepin County, Minmota, Dunkirk Meadows, Hennepin County,
Mknasota; and
WHERBAS, it was deomriined by the City t uuncil that said easements were not needed for
public purpose,;
NOW, TWEIZORB, BE 1T HEREBY RESOLVED BY TEM CITY COUNCIL OF MM
CITY OF PLYMOUTH, AIIDVNiiSOTA: That the following part of Dunkirk Lane Right -of -
Way, Seven Ponds Second Ad ltion, Hennepin Courcy, Minnesota, Dunkirk Maaduws,
Hennepin County, Minnesota be vacated:
That part of Dunkirk Lane as dedicated on the plat of Seven Ponds Second
Addition, :jeanepin County, Minnesota, and on the plat of Dunkirk Meadows,
Hennepin County, Minnesota lying norft ly of the southerly line of Lot 11
Block 6, and its easterly extension as platted in Seven Ponds Second Addition.
FURTfidR, that said vacation shall not affect the authori►y of any person, corporation, or
municipality owning or controlling the electric or telephone poles and linea, gas and sewer
lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same
or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or
otherwise attend thereof.
Adopted by the City Council on March S, 1997.
