RESOLUTION NO. 97-156
AUTHORIMG TIRE VACATION OF
EASEMENT RIGHTS FOR UTILITY PURPOSES OVER AND ACROSS
VACATED COUNTY ROAD 61 AND COUNTY ROAD 15 DESCRIBED IN
DOCLINUM NO, 1776514
WHEREAS, a petition was received to vacate easement rights for utility purposes over and
across vacated County Road 61 and County Road 15 described in Document No. 1716514; and
WHEREAS, said petition was signed by a mkjority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public bearing with respect to acid vacation was scheduled for Mamb S, 1997 in
aeoondanee with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two waha prior
to the meeting of Manch 5, 1997; and
WHl3REAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, Northern States Power Company, Minnegasco and U.S. West have been duly
notified of the proposed vacation and have no objection thereto; and
WHEREAS, the Council did hold a public hearing on March 5, 1997 to inform any and all
interested partes relevant to the vacation of easement rights for utility purpose over and
across vacated County Road 61 cams County Road 15 described in Document No. 1776514; and
WHEREAS, it was detwmined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE rr HEREBY RESOLVED BY THE CrrY COUNCIL OF THE
C17 Y OF PLYMOVIB, MQdMLSOTA: That the following assment rights for utility
purposes over and across vacated County Road 61 and County Road 15 described in Document
No. 1716514 be vacated:
Reservation of easement rights in favor of the City of Plymouth for utility
purposes over and across said vacated toad.
Reservation in favor of any person, corporation or municipality owning or
controlling the electrical or telephone poles and lines, gas and sewer lines or
water lines, mains and hydrants thereof or to enter upon such way or portion
thereof vacated to repair, replace, remove or otherwise amd thereto.
Adopted by the City Council on March 5, 1997.
