HomeMy WebLinkAboutCity Council Resolution 1997-114• CITY OF PLYMOUTH RESOLUTION AUTHORIZING CHANGES TO THE BY-LAWS OF THE PLYMOUTH FIREFIGHTERS RELIEF ASSOCIATION RESOLUTION NO. 97-114 WHEREAS, the Plymouth Fire Relief Association has requested the City authorize changes to their pension fund; and WHEREAS, these changes are allowed and/or required under State Statute; and WHEREAS, at its December 18, 1996 City Council meeting, the Council authorized changes to the by-laws which inadvertently eliminated Article X, Sections I and 2; and WHEREAS, additional housekeeping language changes have been identified that also need updating. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the City Council authorize the correction of and housekeeping changes to the by-laws of the Plymouth Firefighters Relief Association as listed. Adopted by the City Council on February 1% 1997. C: • ARTICLE VIII SECTION 4: Deferred Pensions. If a member of the Association has been a member of the Association for ten (10) years or more and has actively served in the Plymouth Fire Department for ten (10) years or more, but has not reached the age of fifty (50) years, the member may terminate active service with the Plymouth Fire Department and be placed on the deferred pension roll. When the member reaches the age of fifty (50) years, betft shall be entitled to a service pension based on his/,, years of service and the benefit level in effect at the time heft terminated such service. The benefit calculated shall be multiplied by the percentage payable based on years of service at termination. No person receiving a lump sum pension from the Association shall be paid any other benefits by the Association at as outlined in a►ticle VIII Section 4. If a member is receiving or is eligible to receive a Public Employees retirement Association (PERA) pension where the services were primarily for the Plymouth Fire Department in actual fire fighting activities and the City of Plymouth was the employer, then the Plymouth Volunteer FIREFIGHTERS Relief Association monthly pension that the member would receive under ARTICLE VIII, Section 1, shalt be reduced by the amount of the member's monthly PERA pension, providing, however, that no person receiving a pension from the Association as of December 1981 shall have that pension reduced by the application of this provision. • (b). If a member elects to receive a lump sum pension and the member Is receiving or is eligible to receive a PERA pension where the services were primarily for the Plymouth Fire Deparrnient in actual fire fighting activities and the City of Plymouth was the employer, then the lump sum pension that the member would receive under ARTICLE VIII, Section 2, shall be reduced by a percentage equal to the percentage that the member's monthly pension would be reduce 4 under ARTICLE VIII, Section 4(a). ARTICLE X SECTION 1: Spouse's Benefits. Upon the death of a retired member with financial interest, the surviving spouse shall be paid for the remaindcr of the spouse's natural life or until the spouse remarries, the sum of fifty percent (50%) of earned benefits per month for each year that such member served as an active member of the Plymouth Fire Department. SECTION 2: Children's Benefits. Upon the death of anaetiye member-, eF a retired member with a financial interest, the child or children (as a group) shall be paid until the youngest surviving child reaches the age of 18 years or if a fall time student the age of 21 years whichever occurs first, the sum of fifty percent (50%) of earned benefits each month for each year that such member served as an active member of the Plymouth Fire Department. SECTION 2: Upon the death of a retired member with a financ°al interest gF the death of a member on the deferred pension roll, the Association shall pay the sum of $1,000.00 to the retired or deferred member's surviving spouse, or if the retired or deferred member leaves no surviving spouse, to the retired or defen-td member's surviving child or children, or if the retired or deferred member leaves no surviving spouse, child or children, to the retired gi defe d member's estate.
