CITY OF PLYMOUTH
RESOLUTION NO. 97 - 96
ACCEPTING TRUNK HIGHWAY PROPERTY,
DECLARING SAID PROPERTY SURPLUS, AND
AUTHORIZING CONVEYANCE TO THE
ADJOINING PROPERTY OWNER
WHEREAS, in 1994, WestHealth Inc. deeded approximately 0.43 acres to the Minne:oL
Department of Transportation (MnDOT) at no charge to upgrade the intersection of Highway 55
and Northwest Boulevard; and
WHEREAS, WestHealth Inc. is in the process of designing Phase H of their stage development,
which includes a small portion of MnDOT right-of-way: and
WHEREAS, the MnDOT Right -Of -Way Office has determined that the below described property
is no longer required by the State of Minnesota and is willing to convey this excess property to
the City of Plymouth; and
WHEREAS, on January 10, 1997 MnDOT executed a Quit Claim Deed to the City of Plymouth
for the excess property described as follows:
That part of Tract A described below:
Tract A The west 270 feet, lying north of the north line of State Highway No. 55 as located
prior to January 1, 1955, of that part o. the Southwest Quarter of Section 22,
Township 118, Range 22, lying within the following described tract: That part of
the South Half of the Northwest Quarter and that part of the Southwest Quarter of
said Section 22, described as follows: Commencing at a point in the north line of
said South Half of the Northwest Quarter, which point is 16.28 rods wes; of the
northeast corner of said South Half of the Northwest Quarter; thence west along
said north line of said South Half, 48,84 rods; thence south to the south line of said
Section 22 to a point in said south line, which point is 65.44 rods west of the
southeast corner of the Southwest Quarter of said Section 22; thence east along the
south line of said Southwest Quarter, 49.08 rods; thence north to the point of
beginning, which lies southwesterly of a lime run parallel with and distant 25 feet
northeasterly of the following described line: From a point on the north line of
said Section 22, distant 1841,9 feet east of the northwest corner thereof, run
southwesterly at an angle of 75 degrees 30 minutes 45 seconds with said north
section line for 2307.4 feet; thence deflect to the left on a 10 chord spiral curve of
decreasing radius (spiral angle 01 degree 30 minutes 00 seconds) for 200 feet;
thence deflect to the left on a 01 degree 30 minute 00 second circular curve (delta
angle 12 degrees 00 minutes 30 seconds) for 800.56 feet; thence deflect to the left
on a 10 chord spiral curve of increasing radius (spiral angle 01 degree 30 minutes
00 seconds) for 200 feet; thence on tangent to said curve for ti4C.73 feet; thence
deflect to the left at an angle of 59 degrees 17 minutes 05 seconels for 753.13 feet

to the point of beginning of the line to be described; thence deflect to the left at an
angle of 128 degrees 30 minutes 00 seconds for 207.43 feet; thence deflect to the
left on a curve having a radius of 52.09 feet (delta angle 51 degrees 30 minutes 00
seconds) for 46.82 feet; thence on tangent to said curve for 118.92 feet; thence
deflect to the right on a curve having a radius of 150.78 feet (delta angle 55
degrees 16 minutes 45 seconds) for 145.47 feet; thence deflect to the left on a 10
degree 00 minute 00 second curve (delta angle 22 degrees 59 minutes 34 seconds)
for 229.93 feet and there terminating. Together with a strip 5 feet in width
adjoining end northeasterly of the above described strip: Beginning opposite a
point on the above described line, distant 229.93 feet southeasterly of its point of
termination (when measured along said line) and extending southeasterly and
southerly to the northeasterly boundary of said Trunk Highway No. 55; the title
thereto being registered as evidenced by Certificate of Titin No. 436092;
which lies northeasterly of Line i described below:
Lin' 1 Beginning at the southeasterly corner of Tract A hereinbefore described, which is
the westerly corner in the most southwesterly line of LOT 1, BLOCK 1. WEST
SUBURBAN HEALTH CAMPUS ADDITION; thence on an asscuned bearing of
North 59 degrees 34 minutes 00 seconds West along the northwesterly extension of
said most southwesterly line for 92.48 feet; thence deflect to the right on a
tangential curve having a radius of 259.39 feet, and a delta angle of 55 degrees 22
minutes 13 seconds, for 250.67 feet to the westerly line of said Lot 1 and there
terminating
Containing 0.27 acre, more or less.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the above described property is hereby accepted by the
City, is hereby declared surplus and that authority is granted to convey the above described
property to WestHealth Inc. the immediate adjacent property owner, and that the owner shall
combine this excess property with the adjacent property into one taxable parcel.
Adopted by the City Council on February 5, 1997.
