RESOLUTION 97 - 80
APPROVING PRELIMINARY PLAT FOR DAHLSTROM, PETERSON, EIDEN
PARTNERSHIP FOR PLYMOUTH OAKS 2ND AL' DITTION LOCATED NORTH OF
ROCKFORD ROAD AND WEST OF BERKSHIRE LANE (96173)
WHEREAS, D2h1strom, Peterson, Eiden Partnership has requested a Preliminary Plat
for Plymouth Oaks 2e0 Addition, a plat of eight single family lots on a 6.8 -acre parcel
located at the north of Rockford Road and west of Berkshire Late; and
WHEREAS, the subject property is legally described as follows:
Lot 3, Block 3.Oudots A, B, and C, Plymouth Oaks, also
Lot 9, Block 1, Courtyards of Plymouth Oaks, also
The East Half of the West Half of the East Half of the Southwest Quarter of the
Northwest Quarter of Section 15, Township 118, Range 22, excluding roadways.
WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly
called Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of DL *Astrom, Peterson, Eiden Partnership for a Preliminary Plat for
Plymouth Oaks 2" Addition located at north of Rockford Road and west of Berkshire
Lat>v, subject to the following conditions:
1. Preliminary Plat approval is hereby granted for Plymouth Oaks 2" Addition in
accordance with the plans received by the City on January 2, 1997, except as
amended by this resolution.
2. The developer shall dedicate 100 feet of right-of-way along the south ttorder of the
site for Rockford Road.
3. Minimum setbacks shall be as required for the RSF-2 zoning district.
4. Compliance with the City's Tree Preservation Ordinance.
5. Buffer monuments ,hAll be placed in accordance with Zoning Ordinance Section
21670.07.
6. The developer must obtain all necessary permits from the Bassett Creek Watershed
District.
7. The two wetland areas shall be identified as "Drainage Easements for Ponding"

8. The minimum basement elevations shall be 999.8 for Lots 3 and 4, and 992.0 for
Lots 6, 7 and 8.
9. A Grading Permit and Street Sweeping Contract will be required, along with all
required. financial guarantees.
10. Final Plat submittal shall include t,'te 100 year high water elevation for the wetland
adjacent to the County treatment pond.
11. Additional details will be required for the overflows from the wetlands. This shall
include a cross section of the channel at these locations and the flow rates. The
applicant may be required to construct a concrete weir structure, rather than a rip -
rap.
12. The applicant shall provide a financial guarantee for site improvements related to
the wetland mitigation plan.
13. The developer shall include disclosure information in their marketing/sales
information and purchase agreements regarding the zoning, regulations and existing
development of the property to the east. The information shall include the
telephone number of the Community Development Department as a contact for
further questions.
14. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permits shall be issued until a contract has been awarded for
sewer and water.
D. Compliance with Policy Resolution 79.80 regarding ►ninirnum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
E. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
F. Submittal of required utility and drainage easement documents as
approved by the City Engineer prior to filing the Final Plat.
G. The Dwi c i, per shall hold the City and its officers, employees, and
agents harmicss from claims made by itself and third parties for damages
sustained or costs incurred resulting from plat dpproval and
development. `l"hc Developer shall indemnify the City and its officers,
employees, and agents for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including
attorneys' fees.

H. Payment, of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of recording the Final Plat.
I. Addresses shall comply with the street addressing system.
J. Access to the subdivision shall be restricted from Rockford Road.
K. No Zoning Ordinance Variances are granted or implied.
