HomeMy WebLinkAboutCity Council Resolution 1997-078F CITY OF PLYMOUTH RESOLUTION 97 - 78 APPROVING PRELIMINARY PLAT AND PUD GENERAL PLAN AMENDMENT FOR BRW, INC. FOR PROPERTY LOCATED EAST OF NORTHWEST BLVD. BETWEEN HIGHWAY 55 AND CAMPUS DRIVE (96155) WHEREAS, BRW, Inc. has requested approval of a Preliminary Plat and PUD General Plan Amendment for property legally described as follows; and, Lot 1, Block 1, Northwest Business Campus 4' Addition, Hennepin County, Minnesota. WHEREAS, this property is part of MPUD 81-1 and any action by the City Council at this time does not affect the remainder of the approvals for MPUD 81-1; and, WHEREAS, the Planning Cnmmission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by BRW, Inc. for a Preliminary Plat and PUD General Plan Amendment, subject to the following conditions: 1. Approval of the Preliminary Plat and PUD General Plan Amendment are subject to the approval of the Land Use Guide Plan Amendment application. 2. A Site Plan is approved for a 5,000 square foot gasiconvenience store/car wash, a 6,600 square foot retail building, 12,000 square feet of restaurant, a 10,000 sgeaare foot office and bank with drive-through facilities and a 10,000 square foot office, according to the plans received by the City on December 20, 1996 and January 6, 1997, except as amended by thio• resolution. 3. A Prcliminary Plat is approved for the creation of Lots 1 and 2, Block 1, Northwest Business Campus 13th Addition. 4. The Final Plat shall identify the edge: of Mn/DOT right-of-way and show the distances from the center lines of Highway 55 and Northwest Blvd. 5. Development standards are as follows: a. Front yard building setback: 50 feet, except as noted in Condition 5 b. Side yard building setback: 25 feet c. Rear y, -rd building setback: 35 feet • 96075p, Page 2 d. Front and side yard setback to parking: 2C feet, except that a zero -foot setback is approved for the parking that abuts the loi line for Lot 2. 6. The minimum building setback requirements eom front property lines is reduced to no less than 35 feet for the office building adjacent tv Vision of Glory Church because this site has been designed to provide for internal parking and circulation with yard areas toward the street. There shall be no outside. trash disposal facili-ies and restrictive covenants addressing this requirement shall be filed with the Final Plat 8. The building materials shall include natural c olored brick, masonry and stucco. Uniform materials, signage, color and architectural detailing will be enforced on each building. These requirements will be verified prior to issuance of building permits. 9. Curb area loading is approved for all built tags except the gas/convenience store. The Final Plan shall show a separate loading area meeting Zoning Ordinance standards for this use. 10. Compliance with the Tree Preservation Ordinance. 11. No over story tree shall be located close: than 20 feet to alight standard. This requirement shall be reflected in the Final Plan. 12. The Final Plat will incorporate an easement to accommodate the additional rieght-of-way for double left turn lanes from Campo < Drive to Northwest Blvd. 13. Covenants regarding cross access, parking and fire access shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 14. The developer shall construct a six-foot sidewalk along Campus Drive. This sidewalk shall be shown on the Final Plan. 15. The luminaire plan shall be revised to show that the 0.5 -foot candle contour line does not cross into public right-cf-way. The revised plan shall be submitted prior to issuance of building permits. 16. The Sign Identification Plan for West Health Campus shall include the signs as shown on the plans received by the City on January 6, 1997, however, the existing Northwest Business Campus sign shall remain in its current location. In addition, the applicant shall indicate on the Final Plan whether there will be an additional freestanding sign for the gas/convenience store on Lot 1. 17. Standard Conditions: A. Compliance with the City Engineer's Memorandum, • 0 96075p, Page 3 B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. F. An 8 1/2 x I I inch "Els Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. H. Access shall be restricted from Highway 55 and Northwest Blvd. I. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for ali cost- A ;ages or expenses which the City may pay or incur in consequence of such claims, ..icluding attorneys' fees. J. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. K. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. L. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. M. Compliance with regulations regarding handicapped parking spaces and access.
