HomeMy WebLinkAboutCity Council Resolution 1997-066• CITY OF PLYMOUTH RESOLUTION 97.66 APPROVING CONDITIONAL USE PERMITS AND SITE PLAN AMENDMENT TO ALLOW INSTALLATION OF A MONOPOLE TOWER, PCS ANTENNAS, AND RELATED GROUND EQUIPMENT FOR WIRELLSS CO VIMUNICATION SERVICES AT HAMPTON HILLS GOLF CLUB, 5313 JUNEAU LANE NORTH (96160) WHEREAS, Sprint Spectrum, L.P. has requested approval cif two Conditional Use Permits and a Site Plan Amendment for a 140 -foot high monopole tower to be located on the following described property: The Southeast Quarter of the of the Southwest Quarter of Section 4, Township 118, Range 22, West of the 5° Principal Meridian, according to the Government Survey thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Sprint Spectrum, L.P. for two Conditional Use Permits and a Site Plan Amendment at Hampton Hills Golf Course, subject to the following conditions: 1. This approval is for a Conditional Use Permit to allow a 140 -foot high monopole tower antenna structure, and related ground equipment including a chain link and barb wire fence enclosure, a Conditional Use Permit to allow the height of the tower to exceed 75 feet, and a Site Plan Amendment, pursuant to the application and plans received by the City on October 11, 1996. 2. The project requires applicable building and fence permits prior to installation. 3. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 4. To insure the pos-'hility of co -location in the future, the applicant shall submit a letter of intent co,amitting the tower owner and his or her successors to allow the shared use of the tower if an additional user agrees in writing to meet reasonable terms and conditions for shared use and so long as there is no negative structural impact upon the tower, and there is no disruption to the service provided. If the Hampton Hills Golf Club site or surrounding sites are subdivided in the future, no buildings shall be constructed in violation of the tower setback regulations required by the Zoning Ordinance.
