RESOLUTION NO, 97 -14
AUTHORIZE AMENDING THE DEVELOPMENT CONTILA c f FOR
NANTERRE ADDITION (94093)
WHEREAS, the City of Plymouth 2:,id Weston Corporation have entered into a
development contract dated October 13, 1995 for the development of Nanterre Addition;
and
WHEREAS, as part of this development the developer was required to construct Schmidt
Lake Road in Nanterre Addition in order to conform to the City of Plymouth's
Thoroughfare Guide Plan; and
WHEREAS, in accordance with City policy the developer has constructed Schmidt Lake
Road in accordance with the plans and specification; and
WHEREM, the actual project cost was 22.14% higher than estimated and the
reimbursement to the developer 28.75% higher than estimated because of muck
excavation; and
WHEREAS, Page 12 of the development contract must be amended to include the
increased cost for the state to reimburse the City for this cost (SAP 155-165-03); and
WHEREAS, the City must reimburse the developer for the increased cost prior to the state
reimbursing the City with MSA funds.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That it hereby amend the cost of Schmidt lake
Road noted on Page 12 of the development contract from $603,825 to $768,527 and the
amount of reimbursement to the developer from $572,825 to $737,527.
