HomeMy WebLinkAboutCity Council Resolution 1997-010CITY OZ• PLYMOUTH RESOLUTION 97 - 10 APPROVING SITE PLAN .%4ENDMENT FOR INDEPENDENT SCHOOL DISTRICT 281 FOR PROPERTY LOCATED AT 10635 36THAVENUE N (96120) WHEREAS, Independent School District 281 has requested approval of a Site Plan Amendment for pror. rty legally described as: follows: That part of Government Lot 1 lying north of the westerly extension of the north line of the Southeast Quarter of the Northwest Quarter and tying south of the north 735 feet thereof, also ;hat part of the south 300 feet of the north 735 feet of Government Lot 1 lying east of the west 416 feet thereof except the road, Section 24, Township 118, Range 22, Hennepir, County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approva .. NOW, THEREFORE, BE IT HFRLi3Y RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it shorld and hereby does approve the request by Independeat School District 281 to amend its Site Plan, subject to the following conditions: 1. The Site Plan Amendment is to allow Cooper High School events to be held at Armstrong High School athletic stadium only in the event emergency situations that prevent Cooper events from being held at Cooper High School athletic stadium. 2. An emergency situation is defined as circumstances outside of the control of the School District such m electrical outages or Acts of God which render the Cooper athletic stadium not usable. 3. Prior to any Cooper High School use of the Armstrong athletic facility, the School District shall provide the City with as much notice as reasonably possible of the intended use and the reasons giving rise to the emergency situation that necessitates Cooper's use of the Armstrong facility. 4. That either the Mayor, City Manager or the Manager's designated representative cormitts to the Cooper High School use of tie Armstrong athletic stadium after considerption of the reasons giving rise to the emergency. It is fifrther agreed City consent will not be unreasonably withheld, 5. The light levels shall be adjusted to meet the requirements of Resolution 94-511 before the t.tart of the 1997 football season.
