CITY OF PLYMOUTH
RESOLUTION NO. 96 - 715
AUTHORIZING THE VACATION OF
PART OF 45"' AVENUE NORTH RIGHT-OF-WAY IN
GOLFVIEW ESTATES ADDITION
WHEREAS, a petition was received to vacate a certain portion of 451 Avenue North
right-of-way in Golfview Estates Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the
area proposed to be vacated; and
WHEREAS, a public hearing with respect- to said vacation was scheduled for December
18, 1996 in accordance with Minnesota Statutes 412.851 and the City Charter Section
12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of December 18, 1996; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on December 18, 1996 to inform any
and all interested parties relevant to the vacation of a certain portien of 45' Avenue
North right-of-way in Golfview Estates Addition; and
WHEREAS, it was determined by the City Council that said right-of-way is not needed
for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of 451
Avenue street right-of-way be vacated:
Commencing at the most southeasterly corner of Lot 1, Block 3, said
Golfview Estates; thence northerly along the westerly right-of-way of said
45' Avenue having an assumed bearing of north 1 degree 59 minutes 06
seconds west a distance of 7.71 feet to the point of beginning; thence north
4 degrees 50 minutes 12 seconds west a distance of 99.88 feet; thence
along a circle westerly, southerly and easterly concave to the east having a
radius of 50.00 feet; a central angle of 174 degrees 17 minutes 47 seconds
a distance of 152.10 to the point of beginning.
