HomeMy WebLinkAboutCity Council Resolution 1996-678• CITY OF PLYMOUTH RESOLUTION NO. 96- 678 AUTHORIZATION OF PAYMENT OF INSURANCE DEDUCTIBLE TO LEAGUE OF MINNESOTA CITIES INSURANCE TRUST WHEREAS, the City of Plymouth was insured under the League of Minnesota Cities Insurance Trust Covenant CMC0917909 for the period of April 1, 1988 thru April 1, 1989 and incorporated within this Covenant was Automobile Liability Coverage with limits of $600,000, subject to a $50,000 per occurrence deductible. The cost of defense is included within the coverage and is subject to the $50,000 deductible; and WHEREAS, a Plymouth Police Officer while operating a city owned motor vehicle in the course of his employment was involved in an automobile accident on June 17, 1988; and WHEREAS, the League of Minnesota Cities Insurance Trust in accordance with the terms of the Covenant successfully defended the City of Plymouth and the Police Officer named in the Summons and Complaint against allegations of bodily injury before a Minnesota District Court Jury and a subsequent appeal to the Minnesota Court of Appeals at a cost of $29,449.06. In accordance with the terms of the covr:nant, the League of Minnesota Cities Insurance Trust has requested reimbursement of the cost of defense in the amount of $29,449.06. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the City of Plymouth reimburse the League of Minnesota Cities Insurance Trust $29,449.06 from the Risk Management Fund for the cost of defense. Adopted by the City Council on December 4, 1996. •
