CITY OF PLYMOUTH RESOLUTION 96 - 676 APPROVING PRELIMINARY PLAT FOR HENRY LAZNIARZ FOR FERNDALE PLACE LOCATED AT THE NORTHEAST CORNER OF 12TH AVENUE AND FERNDALE ROAD (96038) WHEREAS, Henry Lazniarz has requested a Preliminary Plat for Ferndale Place, a plat of four single family lots on a 3.1 -acre parcel located at the northeast corner of 12' Avenue and Ferndale Road, presently known as 1220 Ferndale Road North; and WHEREAS, the subject property is legally described as follows: The north 270 feet of the west 453 feet of the northwest quarter of Section 31, Township 118, Range 22 and the south 30 feet of the west 453 feet of the southwest quarter of Section 30, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Henry Lazniarz for a Preliminary Plat for Ferndale Place located at the northeast come, of 120" Avenue and Ferndale Road, subject to the following conditions: 1. Preliminary Plat approval is hereby granted for Ferndale Place in accordance with the plans received by the City on September 9, 1996, except as amended by this resolution 2. The developer shall dedicate 40 feet of right-of-way along the west border of the site for Femdale Road North. 3. Minimum setbacks shall be as required for the R-1 A zoning district. 4. Con nliance with the City's Tree Preservation Ordinance. 5. The Tree Preservation Plan shall he reviewed at the time the Final Plat application is submitted to clarify that all the significant trees are identified on the plan, and that all the tees that will be impacted by the development are appropriately identified for removal or preservation, as approved by the City Forester. • Resolution 96- 676 Page 2 6. Prior to issuance of building permits, buffer monuments shall be placed in accordance with Section 6, Subdivision C. 7 of the Zoning Ordinance. 7. All homes in this subdivision must front toward the private driveway. 8. The addresses for all homes in this development must be posted at Femdale Road and on the individual homes. 9. Submittal of a ten foot wide trail easement along the west border of the site, exclusive of the right-of-way dedication. Notice of such trail easement shall be included in the development/sales documents so that potential buyers will be aware of the future trail for this location. 10. A sign indicating the future trail location shall be posted in the trail easement prior to selling the lots. 11. Prior to filing the Final Plat, submittal of recorded cross -access and cross -utility easement documents. 12. The shared private drive shall be constructed to fire lane standards. Reconstruction of the private drive shall be addressed in the development contract. 13. The applicant shall continue to work with the City Forester regarding any changes to the tree preservation plan, and shall submit the finalized tree preservation plan with the final plat application. 14. With the submittal of the Final Plat, the applicant shall provide plans that demonstrate on-site storm water detention ponding sufficient to maintain runoff rates at pre - development conditions. The rate of runoff post development shall not exceed the one, five, ten, 25, 50, and 100 year storm events of pre -development conditions. 15. If the required follow-up to the wetland delineation indicates the existence of a wetland along Ferndale Road that would be impacted by the proposed development, the applicant shall file for a wetland fill permit from the City of Plymouth. The applicant must obtain any required permit prior to the City's approval of a Final Plat. 16. SAC and REC charges will be payable at the time building permits are issued. 17. Estimated assessment is $44,465.43 for City Project No. 523 - 12'" Avenue Improvements, including street, storm sewer, concrete curb and gutter, sewer lateral, and water lateral. • L Resolution 96- 676 Page 3 18. A 20 foot wide utility and drainage easement is required for the sanitary sewer, watermain, and storm sewer. 19. A drainage easement for ponding to 926.0 is required. 20. The developer must obtain all necessary permits from the MPCA Sewer, Sate Health Department, and Minnehaha Creek Watershed District. 21. Site grading and installation of public improvements shall not commence prior to City Council approval of the Final Plat and Development Contract. 22. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G, The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs inclured resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. I. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. I Compliance with all Fire Codes and policies, including those regarding the location of fire hydrants, fire lanes, and fire lane signage. K. Addresses shall comply with the street addressing system, including re -addressing of the existing home. I,. Access to the subdivision shall be restricted to the shared private drive and shalt be restricted from 12' Avenue. M. No Zoning Ordinance Variances are granted or implied. • • Resolution 96- 676 Page 4 N. The shared drive shall be private and shall be maintained ny the homeowners association. N. Appropriate legal documents regarding Homeowners Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. The documents shall include specific reference to maintenance responsibilities of the shared private drive and the parking restrictions related to the private drive. The documents shall also include disclosure information regarding the suture location of the trail to be located along the east side of Ferndale Road. Approved by the City Council on December 4,1996.
