REIMBURSING DEVELOPER FOR
REQUIRED STREET AND STORM SEWER CONSTRUCTION
SCHMIDT LAKE ROAD
CITY PROJECT NO. 3I 6
WHEREAS, the City of Plymouth and Weston Corp. have entered into a development
contract dated December 11, 1995 for the development of Nanterre Subdivision; and
WHEREAS, as part of this development, the developer was required to construct Schmidt
Lake Road in Nanterre Subdivision in order to conform with State Aid standards for street
construction; and
WHEREAS, as part of the construction of Schmidt Lake Road, the developer is to be
reimbursed for the City's portion of the cost based on the City Assessment Policy; and
WHEREAS, the work to date is certified to conform with State Aid standards for street
construction by Weston Corp.'s engineer as detailed in the approved plans and
specifications; and
WHEREAS, this amounts to $320,136.80,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CCCY OF PLYMOUTH, MINNESOTA; That the developer, Weston Corp., is to be
reimbursed in the amount of $320,136.80 for construction to date of Schmidt lake Road
in accordance with the development contract and City policy,
BE IT FURTHER RESOLVED that the funds be allocated from the City's MSA Fund,
Adopted by the City Council on December 4, 1996.
