HomeMy WebLinkAboutCity Council Resolution 1996-652• CITY OF PLYMOUTH RESOLUTION 96- 652 APPROVING PLANNED UNIT DEVELOPMENT (PUD) AMENDMENT AND CONDITIONAL USE PERMIT FOR OUTSIDE STORAGE AT WESTURN CEDAR SUPPLY, 705 NORTH HIGHWAY 169 (96135) WHEREAS, John Crotteau has requested approval of a PUD Amendment and Conditional Use Permit to allow outside storage at Westurn Cedar Supply located at 705 North Highway 169; and; Whereas the property is legally described as follows: Lot 5 and Lot 6, Plymouth Gardens, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by John Crotteau for a PUD Amendment and Conditional Use Permit to allow outside storage at Westurn Cedar Supply located at 705 North Highway 169, subject to the following conditions: 1. The PUD Amendment and Conditional Use Permit allow outside storage, in accordance with the application received by the City on September 9, !996 with revisions dated November 4, 1996, except as amended by this resolution. 2. The applicant shall install a seven -foot high chain link fence along the south lot line bordering the outside storage area, and along the southern portion of the west lot line bordering the outside storage area. To provide the required screening, the fence shall have slats or fabric, as approved by planning staff. 3. A fence permit is required. 4. Vines spaced fnur feet on center shall be planted along the outside of the fence. 5. If weather conditions do not allow installation of the screen fence this year, le applicant may continue to utilize the area for outside storage until such time PF the fence can be installed provided, however, that the fence is installed no later ban May 15, 1997. If the fence is not installed by May 15, 1997, the applicant would have to discontinue use of the outside storage area at that time or a violation of this condition would occur. 0 Resolution 96-652 Page 2 6. Submission of the required Financial Guarantee and Site Improvement Performance Agreement (SIPA) within 30 days of the date this resolution is adopted. 7. A fire lane and turn -around area must be maintained within the outdoor storage area. 8. The material storage must be set back from the building pursuant to Fire Codes. 9. This Conditiorud Use Permit is subject to all applicable codes, regulations, ordinances, anct special conditions required by this resolution, and violation thereof shall be grounds for revocation of the Conditional Use Permit. 10. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Adopted by the City Council on December 4, 1996.
