HomeMy WebLinkAboutCity Council Resolution 1996-641CITY OF PLYMOUTH RESOLUTION 96 - 641 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR FAZENDIN BROTHERS, INC. FOR "EVERGREEN KNOLL" LOCATED SOUTH OF COUNTY ROAD 6 AND WEST OF URBANDALE LANE (96011) WHEREAS, Fazendin Brothers, Inc. has requested Final Plat approval for Evergreen Knoll Addition, a plat of seven (7) single family lots on a 5.2 -acre parcel situated south of County Road 6 and west of Urbandale; and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for Evergreen Knoll located south of County Road 6 and west of Urbandale Lane, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City, and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Final Plat approval is hereby granted for Evergreen Knoll in accordance with the plans received by the City on September 13, 1996, except as amended by this resolution. 2. Minimum setbacks shall be as required for the R -IA zoning district, including a 25 - foot setback from future 13th Avenue. 3. The developer shall dedicate 54 feet of right-of-way from the centerline of County Road 6. 4. Compliance with the City's Tree Preservation Ordinance. 5. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. s Resolution 96- 641 Page 2 D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Street names shall comply with the City- Street Naming System. I. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. J. Fire Flow calculations shall be approved by the Fire Division prior to issuance cf building permits. K. Private drive access shall be restricted from County Road 6. L. No Zoning Ordinance Variances are granted or implied. M. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat.
