HomeMy WebLinkAboutCity Council Resolution 1996-622CITY OF PLYMOUTH RESOLUTION 96- 622 APPROVING SITE PLAN AMEMDMENT, CONDITIONAL USE PERMIT AND VARIANCES FOR NORTHERN STATES POWER FOR PROPERTY LOCATED AT 123 5 BERKSHIRE (96152) WHEREAS, Northern States Power has requested approval of a Site Plan Amendment, Conditional Use Permit and Variances for property legally described as follows: Lots 4 and that part of Lot 3 lying Easterly of the Easterly right of way of Interstate Highway No. 494, First Addition Greer's Orchard Tracts Hennepin County". Lots 21, 22, 23, and 24, "Parker Lake Gardens". That part of the South 350 feet of the East 5 chains of the West 15 chains of the Southwest Quarter of the Southwest Quarter (SW'/. of SW 1/4) of Section 27, Township 118 North, Range 22 West which lies Easterly of the right of way of Interstate Highway No. 494 as said right of way is described and set forth in Lis Pendens Document No. 3210534. Also, that part of vacated South Street lying West of the Northerly extension of the East line of Lot 4, "First Addition Greer's Orchard Tracts Hennepin County". Also, that part of the Northeast Quarter of the Northwest Quarter (NE'/, of NW '/4) of Section 34, Township 118 North, Range 22 West of the Fifth Principal Meridian, lying West of the Southerly extension of the East line of Lot 21, "Parker Lake Gardens" and Northerly of the Northerly right of way line of the Electric Short Line Railroad. Also, that part of Lot 1, Block 1, Litton Addition, Hennepin County, Minnesota described as follows: Beginning at the Southwest corner of said Lot 1; thence North 300 feet along the West line of said Lot 1; thence East at right angles 45 feet; thence South and parallel with the West line of said Lot 1 a distance of 285.75 feet to the Southerly line of said Lot 1; thence Southwesterly along the Southerly line of said Lot 1 a distance of 47,20 feet to the point of beginning, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Northern States Power for a Site Plan Amendment, Conditional Use Permit and Variances, subject to the following conditions: 1, A Site Plan Amendment and Conditional Use Permit ate approved for a 30 -foot high, 750 -foot long salt barrier, subject to the plans received by the City on October 25, 1996, except as modified by the following conditions. • 96090, Page 2 2. Variances are granted for the construction of a 30 -foot high barrier located 10 feet from the property line. The Variances are granted based on the findings that the requests stem solely from the design requirements of an effective salt barrier and they will not be dxtrimental to the public welfare. 3. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on November 20, 1996. STA'IT.
