RESOLUTION 96
APPROVING SITE PLAN, CONDITIONAL USE N -1\&AIT, AND TWO ZONING
VARIANCES, AND DENYING ONE ZONING VARIANCE FOR GOLDRIDGE
GROUP FOR PROPERTY LOCATED NORTH OF HIGHWAY 55 AND
SOUTHWEST OF HARBOR LANE (96125)
WHEREAS, the Goldridge Group has requested approval of a Site Plan, Conditional
Use Permit, and Variances to allow construction of a 33,336 square foot building for
office and day care use on property legally described on Exhibit "A", attached hereto
and hereby made a part hereof; and,
WHEREAS, the Planning Commission has reviewed ::?id request at a duly called Public
Hearing and recommends approval of the Site Plan, Conditional Use Permit, and two
Variances.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCII, OF
THE CITY OF PLYMOUTH. MINNESOTA, that it should and hereby does approve
the request by the Goldridge Group for a Site Pian, Conditional Use Permit, and two
Zoning Variances, subject to the following conditions:
1. The Site Plan, Conditional Use Permit, and Variances allow the construction of a
33,336 square foot building with 19,968 square feet for office use and 11,360
square feet for a day care facility, according to the plans received by the City on
September 27, 1996, except as amended by this resolution.
2. This resolution approves a Variance to allow a waiver of the requirement for one
truck parking space on the site with the finding that the request mcoets all the
applicable Variance standards, as follows: 1) enforcement of this requirement
would create an undue hardship to the applicant because this site would generate
little if any semi -truck traffic; 2) the purpose of the Variance is not based on a
desire to increase income potential; 3) the Variance would not be detrimental to the
public welfare or injurious to adjacent properties; and 4) the Variance would not
increase congestion in the public streets, increase the danger of fire, or endanger
public safety.
3. This resolution approves a Variance to allow an illuminated off-site directional sign
along Harbor Lane with the finding that the request meets all the applicable
Variance standards, as follows: 1) the difficulty arises out of the site configuration
because the only access to this lot is from Harbor Lane, however, the lot does not '
have any frontage on Harbor Lane: 2) the purpose of the Variance is not based on a
desire to increase income potential; 3) the hardship or difficulty was not created by

the applicant; and 4) the directional signage would help to eliminate confusion,
thereby reducing congestion in the public right-of-way and improving traffic safety
in the area.
4. This resolution denies a Variance to allow the off-site directional sign (approved in
Condition No. 3 above) to have a surface area of 12 square feet, where four square
feet is the maximum surface area allowed. This denial is based on the finding that
the applicable Variance standards cannot be met because no particular hardship
exists, and signage to identify individual tenants could be located on the site.
5. Prior to issuance of the sign permit for the off-site directional sign referenced in
Condition No. 3 above, the applicant shall obtain a signage easement from the
adjacent restaurant to allow placement of such sign.
6. Tha day care facility shall be licensed by the State.
7. Prior to issuance of building permits, submission of a lighting plan indicating a
maximum 0.5 foot-candle at the lot lines, with the exception that the lighting along
the north and east borders of the site may exceed 0.5 foot-candle if the applicant
obtains a lighting easement from the abutting land owners to the north and east.
8. Approval by Bassett Creek Watershed District required prior to issuance of building
permits.
9. This resolution approves a Fire Code Variance to the requirement for a fire lane
within 50 feet of all sides of the building.
10. Prior to issuance of building permits, revised plans indicating the following:
A. The southernmost hydrant/island located along the east lot line shall be relocated
to the south as approved by the Fire Inspector.
B. The Fire Lane sign detail shall be imprinted on the plans.
C. The Plymouth Fire Department Notes and Temporary Access Roads and Water
Supply Policy shall be legible on the plans.
D. Compliance with the approved locations for the Fire Department Connection
and Post -indicator Valve.
E. All plans must be signed.
11. Prior to issuance of building permits, the applicant shall obtain easement
agreements with the abutting properties to the north and east to ensure unobstructed
access to the hydrants, drive aisles, and water supply.

12. Prior to issuance of building permits, payment of park dedication fees -in -lieu of
dedication in accordance with the Dedication Policy in effect at the time of building
permit issuance.
13. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
14. Standard Conditions:
A. Compliance with the City ; ngineer's Memorandum.
B. Compliance with the Fire Inspector's Memorandum..
C. Compliance with Policy Resolution 79.80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
D. Submission of required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of.
the date of this resolution.
E. Any signage shall be in compliance with the Ordinance, except as noted
in Condition No. 3.
F. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
G. Compliance with all Fire Codes and policies, including those regarding
the location of fire hydrants, fire lanes, and fire lane signage.
H. An R 1/2 x 11 inch "A-, Built" Fire Protection Plan shall be submitted
prior to the release or relitiction of any site improvement bonds per City
Policy.
I. Priot to issuance of building permits, submission and approval of fire
flow calculations.

recorded plat thereof, Hennepin County, Minnesota, lying southerly of the following
described Line A:
Commencing at the northwest comer of Lot 6, Block 1, Fox Meadows First
Addition; thence on an assumed bearing of south 00 degrees 44 minutes 45
seconds west along the west line of Lots 5 and 6 a distance of 355.00 feet to the
point of beginning of said Line A; thence south 89 degrees 15 minutes 15
seconds east a distance of 444.00 feet to the point of termination of said Line A;
and lying westerly and northwesterly of the following described Line B:
Commencing at the point of termination of said Line A; thence south 00 degrees
44 minutes 45 seconds west 84.67 feet; thence south 24 degrees 41 minutes 06
seconds west 233.24 feet to the intersection with the south line of said Lot 4 and
