HomeMy WebLinkAboutCity Council Resolution 1996-601• 1. CITY OF PLYMOUTH RESOLUTION 96-601 APPROVING A PRELIMINARY PLAN/PLAT FOR J.'NCO INC. FOR PROPERTY LOCATED AT 4860 PEONY LANE NORTH (96113) WHEREAS, Janco Inc. has requested approval of a Preliminary Plan/Plat for the development of approximately 20.38 acres located at 4860 Peony Lane North; The property is more specifically described as: That part of the Northeast quarter of the Southeast quarter of Section 7, Township 118, North Range 22, West of the 5i° Principal Meridian, lying North of the Soo Line Company's right-of- way. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Janco Inc. for a Preliminary Plan/Plat, subject to the following conditions: 1. Approval of the Preliminary PlarvTlat is contingent on the adoption of the associated Land Use Guide Plan Amendment, the City's New Zoning Ordinance and the Zoning Ordinance Map Amendment reclassifying the land from FRD to RMF -2. 2. The approved Preliminary Plan/Plat shall be in compliance with the plans dated October 8, 1996, and October 22, 1996, except as amended by the Resolution. 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat in combination with a trail easement along Schmidt Lake Road. Notice of the trail easement shall be included in the development/sales documents so that potential buyers will be aware of the future trail for this location. 4. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and filing of the Final Plat, The Final Plan/Plat shall be revised to be consistent with the Mitigation Plan. 5. Prior to the issuance of building permits, wetland buffer monuments shall be installed in accordance with Section 6, Subdivision C.7 of the Zoning Ordinance. The monument design shall be approved by the Community Development Department. 6. Compliance with the Tree Preservation Ordinance. 0 7. Development Standards: a. 25 -foot front yard setback b. 50 -foot front setback minimum from Peony Lane and Schmidt Lake Road C. 8 -foot side yard setback to living areas d. 6 -foot side yard setback to garages e. 25 -foot rear yard setback f. 50 -foot rear yard setback to the railroad right-of-way g. 15 -foot setback from wetland buffer h. Average 50 -foot wetland buffer to High Quality wetlands i. Maximum lot coverage of 40 percent 8. The Final Plan shall include a revised Landscape Plan that Shows overstory trees at 30 - foot spacing inside tt : fence line along the railroad tracks. 9. The Final Plat shall not be recorded until the City has awarded a contract for construction of Schmidt Lake Road. No occupancy permits will be issued until Schmidt Lake Road has curb and gutter. 10. There are no easements to the north for storm drainage, therefore the ponds shall be constructed for detention to the predevelopment rate and treatment for water quality. The rate of runoff shall not exceed the one-, five-, ten-, 25- and 100 -year storms. 11. The Final Plan shall show how storm drainage to the east will be controlled to the predevelopment rate. 12. Standard Conditions: A. Compliance with the City Engineers Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permit shall be issued until a contract has been awarded for sewer and water. D. Street names shall comply with the City Street Naming System. E. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. G. Private driveway access shall be limited to internal public roads and restricted from Peony Lane and Schmidt Lake Road. H. Appropriute legal documents regarding Homeowners Association documents, covenants and restriction ace approved by the City Attorney shall be filed with the Final Plat.. 1. Location and number of fire hydrants shall be approved by the Fire Division. I Submittal of fire flow data with the Final Plan/Plat. K Approved fire department turnarounds will be re( ed on the east end of 48th and 49th Avenues. L. All lots abutting ponds shall have basement elevatiams at least two feet above the 100 year high water elevation. M. A maintenance agreement is required between the Developer and the City for the water quality ponds. N. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. 0. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
