RESOLUTION 96 - 583
APPROVING MPUD PRELIMINARY PLAN AND FINAL PLAN/PLAT FOR
PLYMOUTH PONDS DEVELOPMENT IV, L.L.C. (MOEN LEUER
CONSTRUCTION) FOR ONE LOT LOCATED NORTHWEST OF MEDINA ROAD
AND COUNTY ROAD 24 (MPUD 91-1) (96096)
WHEREAS, Plymouth Ponds Development IV, L.L.C. (Moen Leuer Construction) has
requested a MPUD Preliminary Plan and Final Plan/Plat for one building in the
Plymouth Ponds Business Park Second Addition located northwest of Medina Road and
County Road 24; and,
WHEREAS, the Planning Commission has considered the request at a duly called
Public Hearing and recommends approval,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the MPUD Preliminary Plan and Final Plan/Plat for one building in the Plymouth
Ponds Business Park Second Addition located northwest of Medina Road and County
Road 24, subject to the following conditions:
1. The MPUD Preliminary Plan and Final Plan approval permits construction of a
110,632 square foot industrial budding on Lot 1, Block 1, Plymouth Ponds
Business Park Second Addition, in accordance with the plans received by the City
on June 29, 1996, revisions dated August 9, and August 15, 1996, except as
amended by this resolution.
The approved MPUD Final Plat is for the creation of Lot 1, Block 1, Plymouth
Ponds Business Park Second Addition
3, Development standards shall comply with the Zoning Ordinance standards. No
PUD flexibility is granted by this approval.
4. Outside storage is prohibited anywhere in this development,
5. Prior to the issuance of building permits, the applicant shall submit revised plans
that include or identity the following items:
A, Allowable area calculations,
B, Signage setback from the lot lines,
C, Lighting plan showing that .5 foot-candles will not cross the lot lines.
D. Compliance with applicable State Handicap parking requirements,
E, Fire lane engineering detail.

F. Relocate fire hydrants and the post indicator valve
6. Cross access easements shall be submitted to the City and filed with Hennepin
County. The easements shall permit all traffic in the development the use of
County -approved access to County Road 24.
7. Any signage shall be in compliance with the Ordinance and the approved Master
Sign Plan identified on sheet A-1 of the plans dated May 19, 1995.
8. Additional landscaping shall, by the end of 1996, be installed within the Plymouth
Ponds Business Park, consisting of additional evergreen trees on the berm abutting
Medina Road east of Holly Lane, from the southeast corner of Holly Lane and
Medina Road to a line 25 feet east of the west wall of Building 2. Trees will be
added to effectively increase the density of trees, at maturity, to be equivalent to a
fence. A dense hedge will be planted on the southeast side of Holly Lane within
the project.
9. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of building permit issuance.
C. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
D. Submission of required Financial Guarantee and Site Performance Agreement
for completion of site improvements within 12 months of the date of this
resolution.
E, Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
F. Compliance with the Ordinance regarding the location of fire hydrants, fire
lanes, and fire lane signage.
G. Submission and approval of fire flow calculations prior to the issuance of
building permits.
H. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior
to the release or reduction of any site improvement bonds per City Policy.
I. All waste and waste containers shall be stored within the buildings.
J. Access shall be limited to internal public roads and prohibited from Trunk
Highway 55.
K. Removal of all hazardous trees from the property at the owner's expense.
