HomeMy WebLinkAboutCity Council Resolution 1996-570CITY OF PLYMOUTH k,SOLUTION NO. 96 -S70 DECLARING PROPERTY SURPLUS AND AUTHORIZING CONVENYANCE TO THE ADJOINING LAND OWNER CITY PROJECT NO. 402 WHEREAS, Hennepin County condemned the Hazel Meyer's parcel of land (northwest quadrant County Road 9 and Berkshire Lane) for the improvement of County Road 9 (City Project No. 402); and WHEREAS, the county, City, and adjoining Developer agreed that all necessary road right-of- way and drainage and ponding easements would be provided for the County Road 9 improvement adjacent to the Plymouth Oaks Development in exchange for other developable property; and WHEREAS, the County conveyed the condemned parcel to the City of Plymouth by Quit Claim Deed reserving an easement for highway purposes. The legal description of the County conveyance and highway easement is described as follows: The East one-half of the West one-half of the East one-half of the Southwest quarter of the Northwest quarter of Section 15, Township 118, Range 22. Reserving to the County of Hennepin an easement for highway purposes over all that part of the above described tract which lies southerly of the following described line: Beginning at a point on the west line of said tract distant 87.54 feet northerly of the south line thereof, as measured at a right angle to said south line; thence North 89 degrees 19 minutes 58 second East a distance of 119.09 feet (the West line of said tract has an assumed bearing of North 0 degrees 03 minutes 55 seconds West); thence deflect left along a non-tangential curve concave to the northwest having a radius of 49 feet. said curve passes through a point on the east line of the above described tract distant 115.70 feet northerly of the south line thereof, as measured at a right angle to said south line and said line there terminating and; WHEREAS, it is in the best interest of the City of Plymouth to reserve drainage and ponding easements over that portion of the conveyed property described as follows: The East one-half of the West one-half of the East one-half of the Southwest quarter of the Northwest quarter of Section 15 Township 118 Range 22 which lies southerly of a line drawn from a point on the west line of the above described tract, distant 350 feet northerly of the southwest corner thereof, to a point in the east line of said tract, distant 270 feet northerly of the southeast corner thereof. 1\Clryyly\wl l\EN4�VKOI�CR\10PRESOL\bECSU RPL.doe RESOLUTION NO. 96-570 PAGE TWO NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the above described property is hereby declared surplus and that authority is granted to convey the above described property to Dahlstrom, Peterson and Eiden Partnership the immediate adjacent property owners, during the replatting process.
