HomeMy WebLinkAboutCity Council Resolution 1996-5690 CITY OF PLYMOUTH RESOLUTION %- 569 APPROVING MPUD FINAL PLAN/PLAT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED WEST OF NIAGARA LANE AT 21ST AVENUE (MPUD 83-1) (96121) WHEREAS, Caliber Development Corporation has requested approval of an MPUD Final Plan/Plat for Parkers Lake Corporate Center for property legally described as follows: Outlot A, Parkers Lake Corporate Center 7' Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber Development Corporation for an MPUD Final Plan/Plat for Parkers Lake Corporate Center, subject to the following conditions: 1. This approval permits the construction of a 91,600 square foot office/warehouse building, in accordance with the plans received by the City on September 18, 1996 (with revised landscaping plan received September 26, 1996), except as amended by this resolution. 2. Any signage shall be in compliance with the MPUD for Parkers Lake Corporate Center. 3. All waste and waste containers shall be stored within the building or within approved trash and recycling enclosures. 4. Prior to the issuance of building permits, the applicant shall submit revised plans that include or identify the following items: A. Location and size of the watermain in Niagara Lane. B. Relocation of hydrants and additional hydrants in locations as approved by the Fire Inspector. C. Relocation of the Fire Department connection, as approved by the Fire Inspector. 6. The trail shall not be used for construction access or storage. Any damage done to the trail must be repaired by the developer. 7. Barricades must be installed when use of the trail is interrupted due to construction. Disruption of use of the trail must be kept to a minimum. Resolution 96- 569 Page 2 8. The trail shall be re -constructed with pedestrian ramps at the site access points. 9. The existing trees along the trail must be protected, as specified by the City Forester. 10. Standard Conditions: A. Compliance with the City Engineer's Memorandums. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fine hydrants, fire lanes, and fira lane signage. F. An 8 112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fire flow calculations prior to the issuance of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. I, Park dedication fees were previously satisfied. K. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. L. No building permits shall be issued until the Final Plat is filed and recorded wirh Hennepin County. M. Final Plat mylars shall refer to MPUD 83-1. Adopted by the City Council on October 16, 1996.
