APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR RICHARD BLOOM
FOR PROPERTY LOCATED AT 16440 OLD ROCKFORD ROAD (96056)
WHEREAS, Richard Bloom has requested a Final Plat for Golfview Woods located at 16440
Old Rockford Road, legally described as:
That part of the northwest quarter of the northeast quarter of Section 17, Township 118, Range
22 west of the 5th Principal Meridian, lying northerly of County Road No. 9, described as
commencing at the southeast comer of said northwest quarter of northeast quarter, thence north
along the east line of said northwest quarter of northeast quarter a distance of 795.77 feet; thence
deflecting 91 degrees 08 minutes 40 seconds left along a line hereinafter called "Line A" a
distance of 106.84 feet to the actual point of beginning; thence deflecting 54 degrees 51 minutes
20 seconds left a distance of 644.21 feet to the centerline of County Road No. 9; thence
northwesterly along said centerline a distance of 276.38 feet; thence deflecting 47 degrees 25
minutes 38 seconds :fight a distance of 370.72 feet to a point on the westerly extension of "Line
A" thence easterly along said "Line A" to the point of beginning.
WHEREAS, the City staff has prepared a Development Contract covering the improvements
related to said plat.
NOW, THEREFORE, BE IT HEREBIX RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should mid hereby does approve the Final Plat and
Development Contract for Colfview Woods, and,
FURTHER, that the Development Contract for said plat be approved, and that the Mayor ind
City Manager be authorized to execute the Development Contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. Final Plat approval is hereby granted for Golfview Woods in accordance with the plans
received by the City on September 27, 1996 and October 3, 1996 except as amended by this
resolution,
2. Minimum setbacks shall be as required for the R-lA Zoning District.
3. Wetland buffer monuments shall be installed on Lot 5 in accordance with Section 6,
Subdivision C.7. of the Plymouth Zoning Ordinance and the City's installation specifications.
4. The four new homes shall be constructed according to the same covenants as adopted by
Golfview Estates.

5. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's expense.
C. Removal of the existing barn on Lots 4 rind 5 prior to issuance of any building permits.
The other outbuilding on Lot 4 may remain.
D. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication
Policy in effect at :he time of recording the Final Plat.
E. No building permits shall be issued until a contract has been awarded for municipal sewer
and water, and the MPCA permit issued.
F. No building permits shall be issued until the Final Plat has been filed and recorded with
Hennepin County.
G. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
H. Street names shall comply with the City Street Naming System.
I. The existing home on Lot 3 will be re -addressed off 45th Avenue North.
J. Submittal of required utility and drainage easements as approved by the City Engineer
prior to filing the Final Plat.
K. Fire flow calculations shall be approved by the Fire Division prior to issuance of building
permits.
L. Compliance with the terms of City Council Resolution 89-439 regarding Tree
Preservation.
M. The Development Contract, as approved by the City Council, shall be fully executed prior
to release of the Final Plat.
N. Access shall be restricted from Old Rockford Road. The existing driveway crossing at
Rockford Road shall be removed prior to any new building uccupancy.
0. No yard setback variances are granted or implied.
P. The Developer shall hold the City and its officers, employees, and agents harmless from
claims made by the developer and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the City
and its officers, employee, and agents for all costs, damages, or expenses which the City
may pay or incur in consequence of such claims, including attorneys' fees.
