HomeMy WebLinkAboutCity Council Resolution 1996-565CITY OF PLYMOUTH RESOLUTION %- 565 APPROVING VARIANCE FOR PREETHY AND ANSLEM GOONETILLEKE FOR LITTLE FLOWERS MONTESSORI, LOCATED AT 4155 ZACHARY LANE NORTH (96130) WHEREAS, Preethy and Anslem Goonetilleke have requested a Variance to allow a front yard fence with a height of five feet, where three feet is the maximum height allowed; and WHEREAS, the subject property is located at 4155 Zachary Lane North, legally described as follows: Eastern 269 and five -tenths feet of southeast quarter of the northeast quarter, south of Rockford Road except roads of Section 14, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed the Variance request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby dues approve the request of Preethy and Anslem Goonetilleke for a Variance for Little Flowers Montessori located at 4155 Zachary Lane North, subject to the following conditions: 1. The fence height Variance is hereby granted for 4155 Zachary Lane North in accordance with the plans received by the City on August 30, 1996, except as amended by this resolution. 2. The Variance is granted based on the finding that the request meets the Variance Standards, specifically: 1) The purpose of the variance is based on a need to provide reasonable safety for the children enrolled at the facility rather than a desire to increase the income potential of the property. 2) The hardship is not created by the applicant. 3) The variance would not have adverse impacts on surrounding properties. 4) The variance would not impair an adequate supply of light or air, or substanti311y increase the congestion of public streets. Approved by the City Council on this 16th day of October, 1996. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
