RESOLUTION 96- 560
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT (RPUD) FINAL
PLAN/PLAT FOR WESTON CORPORATION FOR "THE COURTS AT
NANTERRE" LOCATED WEST OF VICKSBURG LANE AND NORTH OF
HOLLYDALE GOLF COURSE (RPUD 95-3) (96023)
WHEREAS, Weston Corporation has requested approval of an RPUD Final Plan/Plat
for the development of approximateiy 13.3 acres located west of Vicksburg Lane and
north of Hollydale Golf Course, legally described as Outlot L, Nanterre; and
WHEREAS, the City staff has prepared a Development Contract covering the
improvements related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the RPUD Final Plan/Plat for The Courts at Nanterre, and,
FURTHER, that the Development Contract for said plat be Approved, and that the
Mayor and City Manager be authorized to execute the Development Contract on behalf
of the City, and,
FURTHER, that the following conditions be met prior to recording of, and related to
Said plat:
1. RPUD Final Plan/Plat approval is hereby granted for The Courts at Nanterre, a 37 -
unit townhome development, in accordance with the pians received by the City on
September 27, 1996 except as amended by this resolution.
2. A sigr. shall be placed at the entrance to the subdivision identifying the location of
Schmidt Lake Road and the dedicated right-of-way for Comstock Lane. The sign
shall comply with the conditions of City Policy 88-494 regarding development
signage showing arterial roads. A sign permit application shall be approved prior to
the issuance of building permits.
3. A 25 -foot back to back street width design is approved for 49' Place North in this
subdivision.
4. The private driveways shall be concrete and no wider than 18 feet.
5. Parking shall be prohibited on 49th Place North and all private drives.

6. Drainage from approximately 13 additional acres of this site shall be directed away
from the Hollydale Golf Course, subject to Watershed District approval. The 13
acres are identified in an agreement between Weston Corporation and Hollydale
Golf Course dated May 1, 1995.
7. A five-foot chain link fence shall be installed on the property line between
Hollydale Golf Course and Nanterre. The fence shall have a black or green vinyl
coating.
8. Prior to filing the final plat, revised plans shall be submitted indicating installation
of a 20 -foot wide fire lane to be extended 150 feet southward into future Coms.ock
Lane, as approved by the Fire Division.
9. Prior to filing the final plat, revised plans shall be submitted indicating additional
fire hydrants, as approved by the Fire Division.
10. Prior to filing the final plat, a revised Final Site Plan shall be submitted indicating
that the two off-street parking spaces at the end of the 49" Place North cul-de-sac be
located entirely on private property.
11. Development Standards are:
A. 19 -foot building setback to the back of the 49th Place N. curb
B. 18 -foot building setback between buildings
C. 20 -foot building setback to the south subdivision property line
D. 30 -foot building setback to the railroad right-of-way
E. 50 -foot building setback to Schmidt Lake Road
F. 25 -foot building setback to Comstock Lane right-of-way
G. 15 -foot building setback to wetlands
K. 22 -foot parking stall in front of each garage
I. 65 percent -maximum townhome lot building coverage
12. Standard Conditions:
A. Compliance with City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's expense.
C. No building permit shall be issued until a contract has been awarded for sewer and
water and the MPCA Permit is Issued.
D. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County except that one permit may be issued for a model home.
E. Compliance with Policy Resolution 79-80 regarding minitnum floor elevations for
new structures on sites adjacent to, or containing any open storm water drainage
facility.

F. Prior to issuance of building permits, buffer monuments shall be placed in
accordance with Section 6, Subdivision C.7 of the Zoning Ordinance.
G. The developer shall install wetland monumentation delineating the wetland within
each lot. The monument design shall be approved by the Community Development
Department.
H. Street names shall comply with the City Street Naming System.
I. Final Plat mylars shall refer to RPUD 95-3.
J. Private driveway access shall be limited to internal public roads and restricted from
Schmidt Lake Road.
K. Submission of the required Financial Guarantee and Site Improvement Performance
Agreement prior to issuance of building permits.
L. Appropriate legal documents regarding Homeowners Association documents,
covenants and restriction as approved by the City Attorney shall be filed with the
Final Plat. The documents shall include specific reference to maintenance
responsibilities of the private driveways, landscaping in public right-of-ways, and
the no parking requirements on 49th Place North and the private drives. The
documents shall also include disclosure information regarding the future location of
trails, as well as the location and operational aspects of the Soo Line Railroad and
the location and design of the City water tower located at Schmidt Lake Road and
Vicksburg Lane.
M. Compliance with the Tree Preservation Policy.
N. Park dedication shall be cash fees paid at the rate in effect at the time of filing the
Final Plat with Hennepin County.
0. Compliance with all policies and codes regarding fire safety, including the
placement of fire lane signage.
