APPROVING MPUD FINAL PLANIPLAT FOR OPUS NORTHWEST L.L.C. FOR
PROPERTY LOCATED EAST OF NORTHWEST BOULEVARD AT XENIUM LANE
(96108)
WHEREAS, Opus Northwest L.L.C. has requested approval of an MPUD Final Plan/Plat for
Northwest Business Campus for property legally described as follows:
Outlot A, Northwest Business Campus 10th Addition
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Opus Northwest L.L.C. for an MPUD Final Plan/Plat for Northwest Business Campus subject
to the following conditions:
1. This approval permits the construction of an 82,405 square foot ofFu ;/warehouse building,
in accordance with the site plans received by the City on August 30, 1996 with revisions
received on September 13, 1996, and with the final plat plans received by the City on
September 30, 1996, except as amended by this resolution.
2. The City shall receive written notice from the Minnesota Pollution Control Agency that the
Indirect Source Pennit for the Northwest Business Campus has been amended for this
project, or the City shall receive documentation that such amendment is not required.
3. Any signage shall be in compliance with the MPUD for Northwest Business Campus.
4. All waste and waste containers, including those for recycling, shall be maintained within
building or within an approved enclosure.
5. The developer shall enter into an assessment agreement for one-fourth the cost of
signalization for the intersection of Northwest Boulevard and Xenium Lane if and when a
traffic signal becomes necessary at this location.
6. Prior to issuance of building permits, submittal and approval of a revised utility plan that
reflects the elevations indicated on the grading plan.

7. The developer shall provide a wetland buffer strip ranging from 15 to 20 feet in width.
8. Prior to issuance of building permits, buffer monuments shall be placed in accordance with
Section 6, Subdivision C. 7 of the Zoning Ordinance.
9. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
C. Final Plat mylars shall refer to MPUD (81-1).
D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
E. Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of the
date of this Resolution.
F. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
G. Compliance with the Ordinance regarding the location of fire hydrants, fire
lanes, fire department connections, post -indicator valves, and fire lane signage.
H. An 8 112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
I. Submission and approval of fire flow calculations prior to the issuance of
building permits:
J. The permit is subject to all applicable codes, regulations anO. ordinances, and
violation thereof shall be grounds for revocation.
K. Park dedication fees shall be cash fees in lieu of land dedication in accordance
with the dedication policy in effect at the time of building permit issuance.
L. The Developer shall hold the City and its officers, employees, and agents
hantiless from claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development. The Developer
shall indemnify the City and its officers, employees, and agents for all costs,
damages or expenses which the City may pay or Incur in consequence of such
claims, including attorneys' fe
M. The existing trail shall not be used for construction access or storage. Any
damage done to the trail must be repaired at the developer's expense.
