HomeMy WebLinkAboutCity Council Resolution 1996-557• CITY OF PLYMOUTH RESOLUTION 96 - 557 APPKOVING FINAL PLAT FOR DEAN AND ALICE FJELSTUL FOR SYCAMORE WOODS LOCATED AT 410 SYCAMORE CIRCLE NORTH (96107) WHEREAS, Dea,i and Alice Fjelstut have requested approval of a Final Plat for Sycamore Woods, a plat of three single family lots on a 3.2 -acre parcel located at 410 Sycamare Circle North; and WHEREAS, the subject property is legally described as Tract B, Registered Land Survey No. 1551, Hennepin County, Minnesota; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Dean and Alice Fjelstul for a Final Plat for Sycamore, subject to the following conditions: 1, Final Plat approval is hereby granted for Sycamore Woods in accordance with the plans received by the City on August 5, 1996 and August 23, 1996, except as amended by this resolution, 2. Minimum setbacks shall be as required for the R -IA zoning district, The site plan indicates that the home on Lots I and 2 would be setback in excess of 25 feet in order preserve trees along Sycamore Circle. 3. Compliance with the City's Tree Preservation Ordinance, 4. Lots 1 and 2 shall share a common access point from Sycamore Circle North and are restricted from having an individudl driveway for each lot, 5. Submittal of cross -access easement documents for the shared access drive for Lots I and 2, prior to Sling the Final Plat, 6, Filing of a preservation easement across the fronts of Lots I and 2 with or prior to filing the Final Plat, The purpose of the preservation easement is to prevent the builders and eventual land owners of these lots from removing the significant trees located within 50 feet of the Sycamore Circle right-of-way that are not specified for removal under the approved Tree Pre::crvation Plan, • 0 Resolution 96- 557 Page 2 7. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, danages, or expenses which the City may pay or incur in consequence of such claims, including attorneys fees. H. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. I. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. J. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within tweave months of the date of this resolution.
