CITY OF PLYMOUTH
RESOLUTION 96 - 549
APPROVING PRELIMINARY PLAT FOR DEAN AND ALICE FJELSTUL FOR
SYCAMORE WOODS LOCATED AT 410 SYCAMORE CIRCLE NORTH (96107)
WHEREAS, Dean and Mice Fjelstul have requested a Preliminary Plat for Sycamore
Woods, a plat of three single faraily lots on a 3.2 -acre parcel located at 410 Sycamore
Circle No►th; and
WHEREAS, the subject property is legally described as Tract B, R.egistured Land Survey
No. 1551, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called
Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request of Dean and Alice Fjelstul for a Preliminary Plat for Sycamore Woods located at
410 Sycamore Circle North, subject to the following conditions:
1. Preliminary Plat approval is hereby granted for Sycamore Woods in accordance with
the plans received by the City on August 23, 1996, except as amended by this
resolution.
2. Minimum setbacks shall be as required for the R -IA zoning district. The site plan
indicates that the home on Lots 1 and 2 would be setback in excess of 25 feet in order
preserve trees along Sycarnort Circle,
3. Compliance with the City's Tree Preservation Ordinance.
4. Lots 1 and 2 shall share a common access point from Sycamore Circle North and are
restricted from having an individual driveway for each lot.
5. Submittal of cross -access easement documents for the shared access drive for Lots 1
and 2, prior to filing the Final Plat.
6. Filing of a preservation casement across the fronts of Lots 1 and 2 with or prior to
filing the Final Plat. The purpose of the preservation easement is to prevent the
builders and eventual land owners of these lots from removing the significant trees
located within 50 feet of the Sycamore Circle right -of --way that are not sNcified for
removal under the approved Tree Preservation Plan.

7. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permits shall be issued until a contract has been awarded for
sewer and water.
D. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
E. No building permits shall be issued until the Final Plat is filed ani
recorded with Hennepin County.
F. Submittal of required utility and drainage easement documents as
approved by the City Engineer prior to filing the Final Plat.
G. The Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third parties for damages
sustained or costs incurred resulting from plat approval and development.
The Developer shall indemnify the City and its officers, employees, and
agents for all costs, damages, or expenses which the City may pay or incur
in consequence of such claims, including attomeys' fees.
H. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of recording the Final Plat.
I. Fire Flow calculations shall be approved by the Fire Division prior to
issuance of building permits.
J Submission of the required Financial Guarantee wnd Site Performance
Agreement for completion of site improvements within twelve months of
the date of this resolution.
