APPROVING FILLING WETLANDS
AND THE WETLAND REPLACEMENT PLAN FOR
DUFFY DEVELOPMENT COMPANY -LMR PRODUCT; BUILDING ADDITION
CITY PROJECT NO. (96071)
WHEREAS, the Duffy Development Company proposes the construction of an addition at IMR
Product Building site, where it is necessary to fill wetlands for this addition, and
WHEREAS, there are no reasouable alternative:; for the location of this facility, and
WHEREAS, a Mitigation Pian was prepared replacing the wetlands in kind at a 2 to 1 ratio
which is required by the amended Wetltmd Conservation Act of 1991; and
WHEREAS, the Replacement Pian meets the requirements of the Wetland Act.
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the Mayur is authorized to execute the LGU'S
Findings of Fact, approving the filling of wetlands and the Replacement Plan for on-site
wetland restoration subject to the following conditions:
1. The replacement wetland must be monitoreC for a five (5) year period frum the date of
completion.
2. The applicant shall prepare an annual mowforing report to the city of Plymouth -in the
anniversary date of the cor^_)letion of the replacement wetland for a period of five (5) years
containing information required in WCA rule 8420.0620.
3. The replacement wedwid must be constructed concurrently with building construction.
4. A deed creating a restrictive covenant running with the land for the replacement area must
be recorded. The deed shall be submitted to the Engineering Division for approval before
recording.
