HomeMy WebLinkAboutCity Council Resolution 1996-5230 CITY OF PLYMOUTH RESOLUTION 96 -523 APPROVING SITE PLAN, VARIANCES, AND CONDITIONAL USE PERMIT FOR THE CITY OF PLYMOUTH AND LIFE TIME FITNESS FOR PROPERTY LOCATED EAST OF PLYMOUTH BLVD. BETWEEN 35TH AND 37TH AVENUE NORTH (96003) WHEREAS, the City of Plymouth and Life Time Fitness have requested approval of a Site Plan, Variances, and Conditional Use Permit for property legally described as follows: Lots 1, 2, 3, and 4, Block 1, Plymouth Center 3' Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, th.-t it shouta and hereby does approve the request by the City of Plymouth and Life Time Fitness for a Site Plan, Variances, and Conditional Use Permit subject to the following conditions: 1. This approval permits the construction of an 89,306 square foot ice arena and a 128,596 square foot fitness center plus an outdoor swimming pool, in accordance with the plans received by the City on March 8, 1996, except as amended by this resolution. 2. Any signage shall be in compliance with the Zoning Ordinance, except as amended by this resolution. 3. All waste and recycling containers shall be stored within the buildings. 4. Restrictive covenants regarding allowable building areas and cross access and parking shall be included in the Ground Lease Agreement between the City of Plymouth and Life Time Fitness. 5. A Variance from the Fire Code is granted for the elimination of the fire lane on the south side of the fitness center. 6. A Variance from the Subdivision Code is granted for the creation of lots without frontage on a public street (Lots 2,3 and 4, Plymouth Hills 3rd Addition). The Variance is based on the finding that: • • A. There are special circumstances that affect this property regarding the pending legal agreement between the City of Plymouth and Life Time Fitness that necessitate the lot arrangements. B. The Variance is not noticeable and will not be detrimental to the public welfare or injurious to other property. 7. Variances from the Zoning Ordinance are granted for building setback, parking location and building coverage. The Variances are based on the finding that: A. The site is transitional between the City Center to the west and the park area to the east and therefore the site should be developed in a way that does not dominate its natural resources. B. The topography and wooded areas of the site, the site's chief amenities, would be unduly and unnecessarily altered if the strict letter of the regulations were carried out. C. The placement of a fence/wall along the street to create the desired "edge" that a smaller building setback would have created will offset the proposed variances for building setback and parking placement. D. The granting of the varim=s will not be detrimental to the public welfare. E. The Variances will not impair an adequate supply of light and air to adjacent property or substantially diminish or impair property values within the area. 8. A Variance from the Zoning Ordinance is granted for two building identification signs on a single lot. The Variance is based on the finding that: A. The pending legal agreement between the City of Plymouth and Life Time Fitness has affected the platting of this property to create a variance where one otherwise would not have been needed. B. The multi -use nature of the site, together with the fact that the uses are both public and private, represents a un,,I ie condition. C. The granting of the variances would not ue detrimental to the public welfare. D. The Variances will not impair an adequate supply of light and air to adjacent property or substantially diminish or impair property values within the area. 9. Approval of a Wetland Mitigation Plan prior to issuance of a grading permit. 10. A Conditional Use Permit is granted for a beauty salon, juice bar, outdoor concession stand (associated with the outdoor pool), physical therapy, massage therapy and a general retail area not to exceed 15 percent of the gross floor area of the fitness center. 11. A Conditional Use Permit is granted for a concession area not to exceed 15 percent of the gross floor area of the ice arena. F • 12. An additional trail shall be added to the south side of the south parking lot connecting Plymouth Blvd. to the building. 13. Standard Condition: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Compliance with the City's Tree Preservation Ordinance. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. F. No more than 25% of the water line shall be devoted to domestic water supply and irrigation purposes. The plans shall included this note. G. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. Adopted by the City Council on October 2,1996.
