HomeMy WebLinkAboutCity Council Resolution 1996-520CITY OF PLYMOUTH RESOLUTION 96- 520 APPROVING MPUD FINAL PLAN AMENDMP14T AND CONDITIONAL USE PERMIT FOR HUTCHINSON TECHNOLOGY, INC. FOR PROPERTY LOCATED AT 5905 TRENTON LANE NORTH (96099) WHEREAS, Hutchinson Technology, Inc. has requested approval of an MPUD Final Plan Amendment and Conditional Use Permit to allow two outside storage tanks at 5905 Trenton Lane North (the property is more specifically described as Lot 1, Block 2, Bass Creek Business Park Addition), and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hutchinson Technology, Inc. for an MPUD Final Plan Amendment and Conditional Use Permit to allow two outside storage tanks at 5905 Trenton Lane North, subject to the following conditions: 1. The MPUD Final Plan Amendment and Conditional Use Permit allows installation of two outside storage tanks and related fencing enclosure and evaporator, in accordance with the plans received by the City on July 3, 1996, except as amended by this resolution. 2. Submission of required financial guarantee and Site Improvement Performance Agreement for completion of this site improvements within twelve months of the date of this resolution. 3. The outside storage tanks are subject to all applicable building permits and must comply with the Fire Code and State Building Code. 4. The Conditional Use Permit is subject to all applicable codes, regulations and ordinances and violation thereof shall be grounds for revocation. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 96- 520 9 page 2 6. The applicant shall develop and maintain on-site, for use by their employees and inspection by city officials, the operation and maintenance procedures for the ammonia system.
