APPROVING CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN
AMENDMENT FOR MAERTENS-BRENNY CONSTRUCTION CO. FOR
IMPROVEMENTS AT ST. BARNABUS CHURCH, 15600 OLD ROCKFORD ROAD

WHEREAS, Maertens-Brenny Construction Company has requested approval of a
Conditional Use Permit Amendment and Site Plan Amendment to allow expansion of
St. Barnabus Church, 15600 Old Rockford Road (the property is more specifically
described as Lot 1, Block 1, St. Barnabus Addition), and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Maertens-Brenny Construction Co. for a Conditional Use Permit
Amendment and Site Plan Amendment to allow expansion at St. Barnabas Church,
15600 Old Rockford Road, subject to the following conditions:
1. The Amended Conditional Use Permit and Site Plan allows construction of two
additions totaling 4,305 square feet in accordance with the plans received by the
City on July 9, 1996 (with revisions received on August 2 and August 13, 1996),
t.xcept as amended by this resolution.
2. The existing utilities must be re-routed so as not to be located under the proposed
expansion areas.
3. Compliance with the State Handicap Code for number, size, and location of
handicapped parking spaces. Additionally, signage identifying Handicap parking
spaces must meet the State Handicap Code.
4. Prior to issuance of building permits, the applicant shall submit a revised site plan
indicating the required ten -foot setback between the parking lot and the building.
5. Approval of fire flow calculations prior to issuance of building permits.
6. Prior to issuance of building permits, submission of a ten -foot wide trail easement
adjacent to Old Rockford Road.

7. Standard Conditions:
a. Compliance with the Engineer's Memorandum.
b. Submission of required financial guarantee and Site Improvement
Performance Agreement for completion of site improvements within
twelve months of the date of this resolution.
c. Compliance with the Ordinance regarding the location of fine hydrants
and fire lanes, and fin lane signage.
d. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
e. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
f. Submission of an 8 112 by 11 inch "as -built" Fire Protection Plan prior
to the release or reduction of the required financial guarantee.
